NEWINGTON When Andy Nowicki was a combat infantryman fighting the Germans in World War II, the army gave him free cigarettes.
Now, the habit he picked up 70 years ago, thanks in part to Uncle Sam, might cost him his home.
The Newington Housing Authority is suing to evict Nowicki, who will turn 90 next month, and his 90-year-old wife, Leona, from their senior housing apartment in Cedar Village.

He should be grandfathered.
look the old timer smoking is a fire hazard to teh oter old people
I am sorry he is having a hard time, buthe can’t smoke inside.
It is probably a health hazard to the old people with COPD
So, he needs to quit or smoke outside.
Exception on the basis that he is old and war veteran doesn’t counterbalance the risk of him setting something on fire since he is so old
The first cigarrete I ever smoked came out of a box of C-Rats.
I believe the term is called "constructive endorsement" or similar. It is a valid defense in many Homeowner's Association Covenant infractions. Say if chain link fences aren't allowed but several homeowners have them, or boats are allowed but the rule is ignored by some and tacitly allowed or overlooked.
However, this being a government-subsidized complex, I doubt they would prevail; the two government pukes running the place have no soul. About the only place you'll see "free cheese" is in a government handout line, or in a mousetrap.....same difference.
The article never said it was inside. It was under a breezeway outside. He was closer than 10 feet from a door or window.
An assumption based on what?
God Bless him.
He’s on a very low fixed income, and I don’t know how he can afford cigs, living in Connecticut. I think they are upwards of $8./pack.
yeah yeah I know
But as he ages he will have a nic fit and not be able to walk outside for a cig
Taking the long view
He was outside...he just wasn’t the required ten feet.....because he can barely WALK.....read the article next time......
There are a things worse than smoke Nazi’s....but not many...
Aw hell, the guy is already 90!, what do you mean “as he ages?”
Somebody get him a fake cigarette. (e-cigarette?) That way there is no fire hazard, and no secondhand smoke to offend anybody.
you are proving my point, he is getting less mobile and will smoke inside and fall asleep and set a couch on fire......
Ditto. But I’ll tell you one thing. I’ll live outside in a tent, under a tarp, or in the woods before I’d EVER live in some government home.
The anti smoking crowd is worse than the global warming crowd.
well, you gotta light the dumb things
how about the electronic cigs? will that work for him?
Nope, the first smoke Nazi that sees it will start coughing reflexively. It doesn’t matter if it’s just water vapor, they ‘see’ it.
I used to eat them all the time way back when....came with little packs of 4 cigarettes.
I hope he doesn’t use sugar in his coffee or salt On his food. He could die for goodness sake!
Aw hell, the guy is already 90!, what do you mean as he ages?
Had to laugh at that one.
I saved about 10 or so thinking they would be a valuable item someday .... but addiction is a powerful thing ... I smoked 'em all.
You assume the policy is based on a fire risk and without knowing the grounds you assume that the breezeway is more likely to be a fire risk than 10 feet from the building.
Let’s say you’re a jogger, or even worse, a bicycler (with the ultralight composite fibre bicycle, Aliens Helment and Spandex long legged panties). Eventually, you WILL cause an accident with a car. We should then force you to be able to ride your bicycle or jog on a sidewalk only.
And Caesar probably doesn't give a sh!t if you were a military veteran, either. In fact, it probably just gives Caesar more of an incentive to be abusive to you because he's been bossing you around ever since he ordered you to land on that beach at Normandy.
I’ll buy him an e-cig setup if he’ll quit smoking inside and they’ll allow it.
lol you are hilarious
I am not trying to protect him from himself
I don’t really give a hoot if he smokes himself to death
but he and the other geriatrics should follow the rules
they aren’t saying they can’t smoke, they just have to do it in a certian place and he won’t do it
the habit he picked up 70 years ago, thanks in part to Uncle Sam, “
...yep. It was Sam’s fault. Why isn’t the press stressing the fact that this man is a warmonger and a drain on society. Where are the bored “youths”? He’s the white devil! Or hasn’t anybody noticed that yet?
Ok Karnak...can I have tomorrows lottery numbers while you are predicting the future?
Look how far we’ve come already when the fact that he cant smoke INSIDE his own home that he PAYS FOR has already been discarded...
Creeping nannystate....and you applaud.
well you two geniuses, he can still walk
some people live to be 100
my grandmother lived to be 96 in one of those warehouses for old people
what would you semantics experts have called it?
yep, that’s right, I do assume it is based on fire risk, what else?
I wish those damn cyclists had to be on the sidewalk
As it is they won’t get single file when a car is coming
they meander around in packs with their behinds stuck in the air
FR needs a name for the likes of you, drive by poster. Try reading the article before commenting. He wasn’t smoking inside. /pet peave rant off
he pays rent, loser. He does not own it
Them the Chickletts and the coffee was about the only things I could stomach.
Newington was establish first by farmers and 2nd by WWI & II vets returning to areas like Hartford and New Britain looking to the burbs for a place to raise a family.
Both my parents were representative of those people.
The scum bags at the housing authority would more than likely fail a 2 or 3 question quiz on these wars which is why the country as a whole is where its at.
Leave these elderly people alone.
Smoke nazi ping
Yeah he PAYS RENT...over 700 bucks a month...therefore it’s HIS HOME....
He has lived there for 20 years....sheesh...
Why don’t you just admit it’s the smoking you don’t like...
I’m surprised the smoking didn’t kill him years ago.
Me too....and I understand your apprehension about the smoking inside stuff but he was trying to at least smoke outside, just not far enough away.
BTW, I don’t give them the satisfaction of calling them ‘cyclists’ because they use that term. I only use ‘bicyclers’ only because it pisses them off. The same goes for the ‘aliens helmets’ and the knee-length spandex panties (that one really pisses them off).
Can they perhaps get him a wheelchair so he can wheel himself the required 10 feet away from the building? Does this place have handicapped ramps? Whether he’s a veteran or not, rules are rules. Sometimes the rules are absurd, but still, if people start making exceptions for this person or that person, etc. what’s the point of having rules?
Didn't they make a movie about that? Punishing people for crimes they might commit at some future time?
I know I want you in those judges robes when my case comes up.
Second hand smoke and noxious, offensive odor.
Mr. Nowiki has at least two disabilities, lack of mobility and an addiction. Call ADA. Karp and Harvey have a legal responsibility to aid a person with disabilities, ie an electric scooter, a sheltered ramp, and a sheltered smoking area. Of course Mr. Nowicki will need someone to assist with his scooter. Come on Mr. Lawyer, lay it on Karp and Harvey.
I smoked Luckies in the old green and white pack from C-rats. Does anyone else remember LSMFT? loose straps and all that? :-)
“rules are rules”
Just curious....when the census take comes around....do you simply tell them how many people live in the house them them tell them to get off your property like I do?
or do you follow the “rules” and divulge a bunch of personal metrics that are not required by law?
Cuz the last time....the guy actually made five trips to my house trying to brow beat me into filling out his little list of questions.....he even tried to talk to my minor children more then once to fish information from them....they knew better and got me each time...
The last trip he threatened to call the county sheriff.....(which I had already been anticipating)...so I hit speed dial on my phone to the deputy at the dispatch desk (non emergency) I had previously talked to about the harassment from the census taker and handed the census taker the phone and said..”here the sheriff is on the phone”...
The census taker got beat red when the deputy instructed him to leave my property or he would be forced to complete a report for trespassing and harassment as I had already provided the information that was required by law.
He cussed me out all the way to his car...and I never saw him again...
A rule is valid if there is a logical reason behind it....could have...might....if...are not valid reasons
“Cuz I said so” is not a valid reason...
People come up with stupid rules all the time....and other people will follow them...
Just like the recent BS about an apt housing unit trying to ban residents from owning firearms...
I own rental property...and I know for a fact that I cant simply change “rules” on a whim and make my rental non smoking...
I’m bound by past practice and the original terms of the lease (besides the fact I wouldn’t do so)..
Don’t like smoking. Think he should be able to smoke as he damn well pleases in his own house.
