Gay Inmates in California Can Get Married

With the demise of Proposition 8 -- the gay marriage ban -- gay inmates in California can get married to their same-sex partners, the Associated Press has reported. In an August 30 memo, state prison officials stated that due to the recent U.S. Supreme Court ruling that "effectively invalidated" Proposition 8, they "must accept and process applications for a same-sex marriage between an inmate and a non-incarcerated person in the community, in the same manner as they do between opposite sex couples."

In case you didn't notice the wording, there is a caveat in that statement...

While a gay inmate can marry a person who is not jailed, two gay inmates cannot get married.

California prison officials state in the memo that there are "security concerns and other legitimate penological interests" for why two gay inmates cannot wed.

It'll be interesting to see if someone challenges that ruling with a lawsuit.

In the meantime, same-sex marriages between an inmate and someone who's not incarcerated can only take place at a jail facility where the inmate is held, but a prison chaplain can refuse to marry the couple based on religious grounds.

So prison officials will allow a person who is "lawfully authorized" to come in and perform the ceremony.

There is really no good reason why a father cannot marry his son, or sons. There is no sexual relations requirement inherent in this new “right” and since there in no danger in bad reproductive possibilities, there is no harm that could result. Since it’s all about marrying those one “loves” it looks to fit the new definition too.

It is appalling discrimination to deny gay criminals the “conjugal right” to live together. Shacking up would make homosexuals more productive and peaceable inmates. The loving, feces-based couples would qualify for parole sooner and ease the overcrowding problem in California prisons.

After all, isn’t sex the highest possible value in society? There is none higher, not even God.

It’s Californicate and there will be a lawsuit .... the one thing besides the sun coming up each morning is that there will be a lawsuit in Californicate when the queers, freaks and perverts don’t get their way.

Federal prisons don't allow conjugal visits (i.e., sexual contact not allowed).

Some state prisons do allow these visits, even having special rooms set up for them.

New York and California now even allow conjugal visits between same-sex married partners (religious OR civil unions).

Wiki has a list of rules of all states regarding conjugal visits. Most facilities require certificates that the partners are AIDs or other STDs-free before these "spouses" drop in for connubial visitations.

I was curious how they handle security for these visits. Couldn’t the incarcerated kill or take hostage the visitor?
