Des Plaines sued after rejecting plans for mosque

A Bosnian Muslim congregation filed a federal lawsuit Monday against Des Plaines and five aldermen, alleging they violated its religious freedom when they denied permission to convert a vacant office building into a community center and Muslim house of worship.

The American Islamic Center claims in the suit that aldermen violated its constitutional rights by refusing to rezone an industrial park to accommodate a mosque.

"We are not happy that we have to file this lawsuit," said Imam Senad Agic. "We are hoping the City Council of Des Plaines would understand our religious needs."

But aldermen say allowing any house of worship in an industrial park would endanger pedestrians and impede neighboring manufacturers.

"I don't care if they're Catholic, Jewish, Muslim, whatever. It's not zoned for that particular area," said Ald. Mark Walsten, who was named in the suit because he voted against an amendment to accommodate the mosque. "Whenever there are children involved in an industrial area, I will not have that on my conscience."

Members of the American Islamic Center, who have rented space in a Rolling Meadows mosque since March 2011, had hoped to purchase the vacant building, formerly occupied by an insurance company. Many of the center's 160 members fled Bosnia in the 1990s to escape war and genocide.

The American Islamic Center claims in the suit that aldermen violated its constitutional rights by refusing to rezone an industrial park to accommodate a mosque.

Does this make any sense at all..They told us no, so this means they violated their constitutional rights...We must sue to have our demands met and nobody is suppose to no to us ? Is what I gather from this story ??

Of course they could buy an existing church, and convert it.

That isn’t what they want.

Ah, but don’t they realize that Zoning laws trump the Constitution, The Torah, The Magna Carta, the Code of Hammurabi, and Even Sharia Law?/s

Seriously, though, it’s not discrimination if they don’t want any “houses of worship”, whatever the religion.

They want it in an industrial area so their bomb factory can use the same site.

Kelo revisted. Most zoning codes are bureaucratic attempts to manage growth. They failed in the free market, but can succeed via government fiat.

Here the politicians are hiding behind their zoning code which disallows that use. They could also argue that they need the revenue.

It’s time to eliminate the corporate income tax and start dismantling local zoning ordinances via the Commerce Clause. We can use Wickard v. Filburn since any economic act by anyone even within their own family was ruled to affect interstate commerce.

Who owns the property has the property rights, but this isn’t the case to use. We also will need a pro-Constitution POTUS.

Good on Des Plaines! We have one of these storefront mosques in our general area and the people close by are screaming about all the.cars literally parked on front lawns and taxis all lined up and down the street!

If an area is zoned for industrial use, that seems to exclude the possibility of a mosque.

How is it a violation of constitutional rights to have a zoning ordinance which excludes certain uses of a property?

OF COURSE, IF a liberal judge hears the case, then zoning laws willall be changed per the whim of Muslim pressure groups.,

If they rezone this to accomodate them, they need to rezone it for anyone

It's an industrial park, designed to generate tax revenue and keep industry centrally located. Putting a tax-exempt "business" there would mean less space for a taxable entity and would probably mean higher taxes for the citizens.

I'd accuse the muzzies of trying to raise everyone's taxes by deception. When a muzzie tries something like this, going on offense is the best way to go; hit 'em back, hard!

Lawyers for the American Islamic Center, including former Cook County Commissioner Tony Peraica, compared the case to one in DuPage County, in which a judge ruled earlier this year that the county had to allow an Islamic worship center to open in a single-family home just outside Naperville.

That’s the money quote. The council is being sued for not changing the zoning, but they have a legitimate reason for it. They also have the authority, whether anyone likes it or not. Unless you can prove religious discrimination (and the money quote precludes that), about the only thing you can do is try to vote them out of office.

We here at FR are quite aware that our elected officials make all sorts of decisions we hate, but like us, these guys will have to accept that life is just not “fair”. :-D

Thing is, the city planning Dept approved the mosque, then the city council denied it. Some of the businesses around there have concerns about traffic safety on Fridays.

From your telling of the auto parking I would guess you are aware of the Muslim/Koran infestation in this Country. An infestation never anticipated or promoted by the Founders or any citizen prior to the 1960s. Arab money and oil especially by Saudi Arabia was been the root. Perhaps this change in culture is what Bush1 meant when he proclaimed ‘a new world order’ that let/left the Saudi king and his two flagships of culture, Mecca and Medina, control the oil supply to the USA along with the money supply of the House of Rothchild.

Islam is a hate cult not a religion and therefore has no expectation of 1st Amendment protection.

In fact, every Mosque in the USA should be considered a weapons of mass destruction factory as the STATED GOAL of Islam is to convert or kill us. In this case we are talking about weaponize humans.

Unfortunately for all of us real Americans our government completely IGNORES this sworn goal of Islam.
