Scalia expects NSA program to end up in court

Supreme Court Justice Antonin Scalia said Wednesday that the courts ultimately will have to determine the legality of surveillance programs by the National Security Agency.
And he's not sure that's a good thing in an era of complex security threats against the United States.
Scalia told the Northern Virginia Technology Council that questions about how much information the NSA can collect about Americans' telephone calls and under what circumstances the agency can monitor conversations are best answered by the elected branches of government.
But he said that the Supreme Court took that power for itself in 1960s-era expansions of privacy rights, including prohibitions on wiretapping without a judge's approval.
"The consequence of that is that whether the NSA can do the stuff it's been doing ... which used to be a question for the people ... will now be resolved by the branch of government that knows the least about the issues in question, the branch that knows the least about the extent of the threat against which the wiretapping is directed," he said.

Good to see he finds time away from his hunting trips with Elana Kagan.

It’s time to RESTORE PRIVACY in the United States of America. The NSA having everyone’s phone calls, Emails and Internet activities STORED IN UTAH FOR RETRIEVAL ANYTIME LATER is BS and in direct violation of our rights to privacy.
I sense an element of butthurt with you. Are you butthurt?

(I could eat it raw, but why do that when I have a fire.)
I watched the head of cybersecurity today on C-Span (Gen. Alexander I think) lay out a good case of why and how NASA and all the other security departments are “supposedly” doing things right to save us from our enemys...It was believiable.....I wanted to believe....and then I got thinking....Would we want to trust them with all our personal info and conversations after seeing how the IRS violated the Tea Party folks???.....NOPE!...Id love to ask the General that...Why should we believe u when nobody has gone to jail for the IRS scandal?.....Equal justice is the bedrock of our Constitution and not a thing is happening to address that crime...Why in the Hell would I trust you now?????

One of the main problems in a nutshell. Congress is supposed to have Zero authority to override the US constitution.
This actually is one for the supreme court. Of course the supreme court does not care about protecting the constitution either.

(Give me back my conservative vote; then find me a real conservative to vote for)
Not to worry, Roberts will rule NSA Surveillance as being a TAX, therefore legal.
Nothing to see here, move along.

Me too! I'm so pissed off at the U.S. gubmint, including the corrupt judicial system, I just want to say to Scalia.... JUST STFU!!! Dumb ass moron, doesn't even realize our country is dying before our very eyes while the elitists & oligarchy are raping & pillaging & plundering our country. And while the destruction of our country goes on, Scalia is cavorting with the enemy like dyke Elena Kagan, and also hobnobs with the ACLU communist Ruth Bader Ginsburg.
Scalia, all in all, you're a traitor just like the rest of the DC liberals, elitists & insiders!
I hope when the SHTF, that the entire Washington DC establishment (including Scalia, Roberts & the entire SCOTUS) bear the full brunt of it!
