Marissa Alexander fired a warning shot into a wall in an act of self defense, but she was blocked from invoking the state's "stand your ground" law.
TALLAHASSEE, Fla. A Florida appeals court is ordering a new trial for a woman sentenced to 20 years to prison after she fired a warning shot in a wall during a dispute with her husband.
The 1st District Court of Appeal ruled that a judge did not properly instruct the jury handling the case of Marissa Alexander.
But the appeals court also said the judge was right to block Alexander from using the state's "stand your ground" law as a way to defend her actions.

Good. That was an absurd sentence.
If I remember correctly, this is the case of a woman, who was arguing with her husband, turned her back on him, went into the garage, got a firearm that was in her car, returned to where her husband was in the house, and fired a shot into the wall.
Funny how the media only includes the details that will reinforce the opinion that they believe you should have.
If you take the time to read the facts of the case, it probably was armed aggravated assault rather than warning shots in a self defense situation. She deserves jail time. Twenty year - I don’t know.
You are right 20 years is a while, but she isn’t so innocent.
I think 20 years is high, because this was not self defense but was not attempted homicide either.
She needed a jail sentence. Even though both of them were probably drunk or stoned, hauling out a gun is not a good solution to your domestic problems. Sentence them both to AA and anger management classes, drop her sentence to 2 or 3 years, and I think Florida will be perfectly safe and fine.
1. She went outside, fetched the gun, and came back inside the residence to “fire her warning shot”.
2. A 20 yr sentence for what amounted to threatening someone with a firearm was absurd.
3. This never had anything to do with FL castle doctrine (SYG), but her lawyer tried to tie it into the Zimmerman case, because she is black and they were seeking a “racial selective prosecution” angle.
If SYG deteriorates to just an excuse to shoot people who piss you off we will end up losing a valuable instrument of self defense.
The liberals know this, they will try to aim SYG toward self destruction.
This case is one of the most poorly reported cases in recent years. The synopsis of what happened:
“According to court documents, Alexander got into an argument with her husband, Rico Gray, after Gray found text messages on Alexanders phone to her ex-husband. Alexander claimed Gray initially prevented her from leaving the bathroom where they were arguing but at some point she was able to get by him and get away.
“Alexander fled the house, but when she got to her car in the garage, she realized she had left her keys inside. So she got her gun from the car and re-entered the house.
“Alexander told police the garage door was broken, and thats why she didnt exit that way. Police found no evidence proving the garage door wasnt working properly.
“When Alexander went back inside, she claimed Gray continued to threaten her so she fired a warning shot through the house — which she fired in the direction of Gray, with his children nearby.
“Alexander was convicted on multiple counts of aggravated assault with a deadly weapon. A jury found the Jacksonville, Florida, woman guilty in just 12 minutes.
“Alexanders own actions were ultimately used against her self-defense claim. While she was out on bail, awaiting trial on her aggravated assault charges, Alexander was arrested for domestic battery against Gray.
“Although her bail contract specifically prohibited any contact between her and Gray, Alexander went to her husbands house — where she wasnt living at the time — and after an altercation, he ultimately called police.
“When the police contacted Alexander about the incident, she first said she didnt know what they were talking about, and she hadnt been at the house, but later she stated that Gray attacked her because she wouldnt stay with him overnight.
“Alexander never called police and later stated she was scared. According to police reports, Alexander had no injuries, but Gray had a bloody swollen eye and told police Alexander had punched him.”
There are additional details, but this woman was anything but a victim here.
Anyone considering a firearm for self-defense should research the laws on self-defense and actually think through the entire process.
Warning shots should only be used when there is an immediate threat to your own life (or in some states property) or the life (property) of another. When a warning shot is used, it should be aimed center-mass at the criminal. That counts as a warning shot because the more dead criminals we bury the clearer the warning to liberals and parasites considering a life of crime.

With today’s prices, it doesn’t make sense to waste ammo on a warning shot.
