Justices to hear gun ban case

The Supreme Court will decide whether a man's Tennessee misdemeanor domestic assault plea should ban him from owning a gun.

The high court on Tuesday agreed to hear an appeal of James Castleman's case...

This could turn out to be a very narrow statutory interpretation decision. The article says the federal statute requires physical force be used to trigger the disqualification and the federal judge threw the case out because the TN assault statute did not require physical force for conviction. If SCOTUS affirms the lower court’s decision, it could just follow that court’s reasoning and never get to any constitutional issues.

A modified misdemeanor domestic assault conviction might screw up their NICS backround check.
