Senate Moves to Violate the United States Constitution

SNIP Senate Democrats are so determined they are even willing to violate the Constitution by empowering the President to raise the debt ceiling.

They are now seeking to violate the United States Constitution as a means of silencing the voice of their opposition, the Republicans. They are planning to vote soon to authorize the President to assume powers that the Constitution clearly states do not belong to the President, the power to raise the debt ceiling. Article 1 Section 8.2 states, “The Congress shall have power to borrow money on the credit of the United States.”

Raising the debt ceiling is all about the power to borrow money on the credit of the United States. That power does not belongs only to the Congress. Not only that, but Congress does not have the authority to give the President that authority because doing so violates the Constitutional process for amending the Constitution. The Congress does not have the authority to change the Constitution, even if they voted unanimously to do so. Article V of the Constitution identifies the process for making amendments. It gives Congress the authority only to propose amendments to the Constitution. Their proposed amendments must then be voted on and ratified by the legislatures of three fourths of the states, which would be 38 states.

Senate Majority Leader Harry Reid is hoping to gain Senate approval of new powers for the President as a means of forcing the Speaker of the House, John Boehner, to allow the House to vote on the same measure. Boehner has so far refused to allow the House to vote on a clean bill to raise the debt ceiling. However, Boehner should resist this pressure on the grounds that it violates the Constitution.

I doubt if 1 in 1000 Americans even knows what the Constitution says, let alone is paying attention to what is happening in DC.

One other factor in this case may be the office of the Senate Parliamentarian. She (Elizabeth MacDonough) should exercise her role to steer Reed (sicK) away from this krap.

The simple fact of the matter is that since there is no audit, we cannot conclude with certainty that the ceiling has not already been exceeded. Having no look into the books, we don’t know for sure that the funds sequestered were actually not spent. We don’t know how much was spent nor for what.

Further, I can speculate with a fair degree of probability that the President is uptight because he knows he has exceeded the debt ceiling illegally and desperately needs it raised to cover his tracks.

This is just grandstanding. The Senators and Obama all know this wouldn’t fly. They just don’t have much real leverage, so they are tossing out fantasy threats like this, or the nonexistent “14th Amendment debt power”.

I think I know the answer but what is the mechanism for restraining a Senate that is out of control and lawless? Only the House can propose bills of spending but they can only go to the President for signature if the Senate agrees. So what can be done if the Senate leader won’t allow a vote? Isn’t it the Senate that is holding the country hostage?

The Justice Department won’t do anything.
Certainly the President won’t do anything.
The Supreme Court has no authority or means to do anything.
Congress can’t do anything.

So what does the Constitution say about how an out of control government is reigned in?

I’d like to see Republican Senators hold a televised caucus meeting where they unanimously approve the House Bill that re-opens the government while denying illegal Obamaare subsidies for Washington insiders and while giving any individual who requests a “fat-cat waiver” the same penalty-free “waiver” that the big corporations and unions get.

Ideally there would be five life-sized cardboard cutouts of American patriots standing with the Republican Senators.

Then, Mitch McConnell could point at those five cutouts and say, “We only need five more PATRIOTS to end the nightmare being imposed on all Americans by this White House and Harry Reid.

Constitutional convention.

The states can collectively override congress, the court, and the president on any matter.

Obama could literally be impeached by the states.

The federal government itself could be dissolved if the states had a solid plan for taking control of the military and critical agencies.

What would happen if state legislatures started convening meetings in a multi-state format to discuss what their options are, and what consensus could be found for convening a constitutional convention?

This is being unconstitutional on steroids. It essentially makes the Legislative Branch a vassal of the WH. If the President can decide to spend money without any real constraints based on the proposition that the government is obligated to do so, what limits are there?

Great analysis....supposedly there are missing funds from sequestration also. You could very well be right.
Not a pleasant thought but certainly a possibility with this creep.

One could argue that (as Obastard has), that raising the debt ceiling isn’t an actual appropriation, but a number that cannot be exceeded in other appropriations bills...

I am uncertain who has the actual “authority” to raise this ceiling if it even exists.

Just heard that the buffoons on the Hill are wanting to start one of their stupid “supercommittees” again. The people need to demand that the first thing this stupid “supercommittee” does is reactivate the U.S. Constitution and the Bill of Rights! They aren’t just “historical documents” for tourists to look at. THEY MEAN SOMETHING!!!

Again, what is the bill? Does a bill even exist yet? Even that NewsMax article doesn’t provide an answer.

So far, I can’t find any introduced legislation on the Senate website that’s references such a thing.

I am tired of political bloggers and journalists sounding alarms, yet they can’t/won’t source their information. They use assumptions and presuppositions to attract and/or scare readers.

It just shows how much the quality of people’s writing skills has diminished.

So far the search results show two other articles that are NOT bloggers, but they still do not show either the name or the number of the legislation.

Might have to write Harry Reid to find out. Most everything these days is done in “secret” and pass it to know what is in it.

If I remember correctly, a similar thing happened in Australia when their government was advocating cap and trade nonsense. I remember reading there was a caravan of trucks, yutes, caravans and family wagons that took to the road to protest the upcoming proposed increases in fuel taxes. Look what just happened there as their populace just gave greenies the boot!
