San Diego Judge Gary Kreep, a conservative legal activist who led a failed fight to challenge President Obama’s citizenship, has been exiled to traffic court after several Superior Court rulings favoring defendants’ constitutional rights.
Kreep, 63, was reassigned on Sept. 9 from the downtown San Diego courthouse to a Kearny Mesa facility that handles traffic offenses and small claims.
The move came after prosecutors from the City Attorney’s Office began to boycott his courtroom over his legal approach.
For instance, Kreep often declined to take away a defendant’s 4th Amendment rights against search and seizure — something prosecutors can legally request at various points during the criminal process.
No official reason was given for Kreep’s reassignment. Presiding Judge Robert Trentacosta said through a spokeswoman that the court doesn’t comment on judicial assignments.

Gary Kreep was an energetic activist for conservative causes in Southern California going back to the 1970’s and ‘80’s.
“Most of the Kearny Mesa facility is staffed with court commissioners, who lack the prestige of a judge and are paid $152,000 a year.”
Commissioners are appointed because the judges are too overwhelmed. Judges have to approve their decisions, however, Commissioners still make the decisions at the trial level and get just as much respect. prestige? what a nonsensical term in this context.
in Kreep’s case, he sounds like he was not exactly impartial and exhibited his Public Defender bias too keenly. Still, traffic court is not for the faint of heart, a pro se litigant is capable of causing a lot more trouble than a represented litigant whose attorney knows the drill. And the variety of cases and litigants is pretty broad. It can be a lot more work than a higher level. On the higher levels, some judges don’t even take the bench, their clerks do everything on some dockets. It looks to be an incredibly boring and taxing job to me, we are lucky anyone wants to do it.
So because he would not rubber stamp the police state, he was banished.
Kreep was NEVER a public defender. Far from it. He was President of United States Justice Foundation, a very right wing group, for decades, fighting battles on abortion, homosexual indoctrination, taxes, and more recently the Obama birth certificate issue.
He just made my short list for 9th Circus...
That and he dared question The Won's bona fides...
Kreep is also a historic footnote with a problematic association with our favorite Russian-Israeli-American-Lawyer-Dentist, with whom he had a sometimes contentious off-on legal (one hopes) relationship.
Offhand, one might possibly imagine that's not altogether a good thing to have on the olde judicial CV.

I mean, he has all the good credentials, why not just apply the law? I can’t stand it when I prove a case past the standard of proof but the judge doesn’t want to give the order of protection because the dude is a hunter or he asks them why they can’t just get along for the sake of their children, when it is way past that, the dude has loaded guns and waves them around the baby when he is pissed off and I can’t extract an order of protection from a judge. He shouldn’t be an activist, he should apply the law in a reasoned fashion. Yes, I am proud of him for taking on the issue of obama’s citizenship, no, it doesn’t sound like that is the only reason he was transferred. If a judge doesn’t follow the law, the lawyers get icked.
His first mistake was not changing his name.
