A 43-year-old father of three has been charged with murder after shooting a rape suspect on his property in New York.
Many are hailing David Carlson has a hero for protecting his family and stopping a rape victim on the loose whom the police were chasing at the time, but because the state of NY does not have a Stand Your Ground law, Carlson has been charged with murder instead of being thanked by the police department.
The accused rapist, Norris Acosta-Sanchez, was on the run from police in Carlsons community. He was found to be living in an abandoned cabin near Carlsons home when police raided the cabin and failed to capture the rape suspect, who fled into the nearby woods.
All of the residents in the area were informed of the rapist on the loose and were on high alert. Carlson was aware of the situation as well, and when he saw the rapist on his property, emerging from the woods he did not take any chances. He fires several shots from his shotgun at the suspect and struck him multiple times.
Acosta-Sanchez was pronounced dead following the shooting.
According to another CBS article, at least one eye witness to the crime thinks Carlson is innocent,
Witness Carmine Ferrera spotted Acosta-Sanchez when Carlson already had his gun pointed at him. Because hes scheduled to testify before a grand jury, Ferrera declined to provide specifics about what he saw, except to say: I didnt see a murder happen. Thats as far as Im going to go.
But police disagreed and arrested Carlson charging him with second degree murder after a lengthy interview with him.
Bail was originally set to $250,000 but the judge lowered it to $50,000. Carlson is not commenting on the case at this time, probably due to advice from his lawyer.
As mentioned in the video, because NY does not have a Stand Your Ground law residents have a duty to retreat, which is a duty that criminals love to see their victims follow. In this case, Carlsons duty was to protect his family, and we will be watching this case closely, which will probably get no major media coverage at all.
As soon as I saw “New York Man” I knew he was doomed.
“and stopping a rape victim on the loose “
“stopping a rape victim on the loose whom the police were chasing at the time,”—sounds about right, the po po chasing the victim and letting the rapist have a pass
Let’s see what kind of testimony the LEOs provide.
Well, I’m optimistic that a grand jury will decline to indict him, assuming he is not in NYC or Ithaca, the City of Evil ;) Where in New York did this take place?
How is this a stand your ground issue? The suspected rapist was neither threatening the gun owner nor fleeing from the scene of a crime against the gun owner.
It is more of a “Stop you dirty b*****d or I’ll shoot” issue. Which is a different thing and a different level of culpability for the gun owner. Isn’t the first thing you are taught in a CC training class to never pull the weapon on someone who not either immediately threaten you or someone else?
The dead man may have been guilty of the things he was suspected of but he might not of been and he was not caught in the act.
Nope, this guy is not a hero though I understand his motives. He deserves to be charged with something.
It happened in Sparrowbush, between Pt. Jervis and Monticello in the SE part of the Catskills. And unfortunately he was indicted by a Grand Jury on Monday.
She spent twelve years in prison for murder. She made the mistake of telling the Judge, she did not regret kiling the man, and would do it again.
It was a travesty, and a tragedy. Her daughter was grown by the time she got out of prison.
The biggest mistake my Patient made was that she left Texas to move to Chicago. Here, she probably would have gotten a ticker tape parade, instead of prison.
You cant go shootn’ any yahoo that strolls onto your property. Not in that state anyways.
This guy could have been the gardener next door or a rapist about to attack his daughter, but with out at least a perceived threat you cant just shoot someone you think might be the guy the cops are looking for....at least not in New Yawk.
Western Kansas be havin’ a parade for him.
she is a heroine. Good for her. she must have had a really shitty lawyer
If he had shot a dog at the same time, he’d have gotten a commendation from the cops.
So you're saying they did manage to bring an indictment on the ham sandwich. From this, it looks as if he'll wind up walking. The judge obviously saw something in the circumstances that made it clear the shooting was not reckless.
It sounds very similar to the African-American John White who waved a gun at a white kid and at some point the gun went off.
If the rapist went for the gun point there may be something similar.
Cuomo should pardon Carlson.
In NYS, duty = Booty.
When Sir Robert Peel proposed to organize the police force of London, Englishmen said openly that half a dozen throats cut in Whitechapel every year would be a cheap price to pay for keeping such an instrument of tyranny out of the State’s hands. We are all beginning to realize now that there is a great deal to be said for that view of the matter. Albert Jay Nock
Sooooo, here we have this well-funded “Instrument of Tyranny” doing what to protect citizens?
Unless you have more info than given in the story wouldn’t you rather wait for some...facts?
There was another article (less than a week ago) when this first happened, which said that the shooter claimed the BG made a move at him while the shooter held the BG at gunpoint, and thats why he shot the BG.
I just searched 5 articles and now can’t find it (they all now seem to have the same story as posted above).
I see someone has already added it but anyone can add key words to an article, it doesn't have to be the original poster.
Be aware, the mod knows who adds which key words. (some people get a little out of hand with key words) I don't mean you.
Poor proofreading. I had the same reaction.
No. He deserves a medal. He got rid or a feral animal. Good day’s work.
Like I been posting for the longest, If you live in one of the Liberal Cities of States and value your ass....leave now. the life you save may be yours. You are playing a game you won’t win and the ante is your life. This man waited too long and once you realize it is time to go, you may not have the opportunity.
He is charged with second degree murder. I would consider that something. He learned a lesson, the hard way.
This guy should get no-billed and the County should pitch in a fresh box of shells as reward for his service to the Community and as a partial apology for their over zealous, anti-self defense persecution.
ha, ha, ha
Like me, you certainly must have listened to Bob Grant on 770 WABC radio, who made it a daily habit to refer to his ultra-liberal father, Governor Cuomo Sr., as sfaccim.
Grant would also invite callers to invoke the sfaccim reference, having them recite the sentence in Italian, addressing the then Governor Cuomo Sr. by his first name, Mario, you are but an ignominious sfacccim or something along those lines.
As a regular listener, caller to the show I myself had said the same on the air during Grant's call-in show.
Google turns up a woman who killed a man after he admitted raping her one year old daughter. In that case, it was a long drawn out revenge killing.
Did your patient kill this guy in her own home?
Yes, it was in her apartment, not a house.
And she went away for 20 for shooting a man caught in the commission of a crime in her own dwelling.
How is this not self-defense? (defense of minor under your care). How was this not thrown out on appeal?
Not doubting you, but something just doesn’t add up.
“Why not thrown out on appeal?”
Easy Q. Lawyers make more money to keep it going.
LOL! That is marvelous! I had met Bob Grant once at Penn Station in New York introducing myself as a listener, he was most congenial, gracious.
Very few could ever understand the camaraderie that evokes. Grazi
MARIO! Azen da me! Tu se proviono SFACCIM!!
