A Lie From Day One
The American Spectator ^ | 10-30-13 | Betsy McCaughey

Posted on 10/30/2013 5:22:11 AM PDT by afraidfortherepublic

Believing in this president is proving to be a health hazard.

~snip~

The liar is none other than the President of the United States. On June 15, 2009, President Obama told a town hall meeting that “No matter how we reform healthcare, we will keep this promise…. if you like your healthcare plan, you will be able to keep your health care plan. Period. No one will take it away. No matter what.”

The fine print in his health law proves that he never intended to keep that promise.

Sec. 1251(a)(1) of the Affordable Care Act (Obamacare) says that no one can be required to give up a plan in effect on March 23, 2010, when the law was passed. Those plans are “grandfathered.” But following that guarantee is a list of costly requirements that made it difficult for insurers to keep offering your plan.

It gets worse. Union plans were “grandfathered” with none of those fine print tricks and exceptions [Sec. 1251(d)].

The law also left open the possibility that the president could impose additional requirements on grandfathered plans (except union plans). Two months after Obamacare was passed, the IRS, Department of Labor, and Department of Health and Human Services — all reporting to the president — churned out hundreds of additional rules to make it even harder for grandfathered plans to survive.

~snip~

Seniors in Medicare Advantage plans are getting a similar run around when they ask about why their doctors are being axed. United Healthcare cut thousands of cardiologists and other specialists from Advantage plans in the New York metro area and Connecticut during October. So much for the promise that grandma can keep her doctor.

My question: if the Act has been changed so much since Congress approved it, is it still legal?

I never understood how a open ended law could be passed allowing an unelected official (Sebelius) to legislate. How did that ALONE pass SCOTUS muster?

Betsy McCaughey has been out in front on this since 2009.
But I still do not trust her. She was a Republican who became a Democrat to help her political fortune, Then back to being a Republican when the grass looked better there.
There is really nothing more inspiring than a chameleon like politician that really has the courage of their convictions.

From the article: "Most of the policyholders dumped this month no longer had their grandfathered plans. Their current plans were cancelled because they don’t provide the “10 essential benefits.” Essential, that is, according to the experts. Fifty-year old couples must pay for maternity care. And straight arrows must pay for substance-abuse treatment."

Same way Congress can create a whole new ‘Dept of ABC’ and ‘give it the power’ to do XYZ.

Neither part Constitutional, but we don’t have a Constitutional Republic anymore...so.

Course, the GOP is JUST about to close that 40yr old Dept of Educ finally, when they get the Pres and Congress majority. I’m sure the rest are soon to follow. *do I need to say it*

Kathleen Sebelius has accomplished what the President couldn’t because he has no line item veto. In Wisconsin, the Governor has something we call the Franken-veto. IOW, the Governor can change a Bill by crossing out punctuation, single letters, whole words, etc. until the Act may mean the opposite of what the legislature intended. Democrat Governors have used this liberally. Republicans, not so much.

But, this has been prohibited to our Presidents. Kathleen has just used a work around. No wonder O won’t fire her. It’s all intended.

She does not have the authority to change law. Again I ask - why hasn't this been made more public?
Maybe it'll come up in today's congressional hearings.

For many years (probably since Nixon resigned), I've believed this country will go through every good, bad and/or ugly event, the same as any other country.
Specifically, that would include a military coup, although I never thought it would happen in my lifetime.
Lately, I'm thinking it might.

Equally as vocal yet more regional in some regards is Dr. David Janda who has been a regular on Glenn's TV Show. He read the entire bill during "that" timeframe, and was on a screed to inform the American Public. Sadly, about 50% of are brethren were or are still asleep.

FDR engendered a coup in 1936, that allowed federal agencies to regulate - effectively, allowing the Executive branch the power to write laws. The USSC ruled it unconstitutional, then FDR made a few threats, then the USSC reversed itself.

Every federal regulation is unconstitutional.

And the USSC said so - before they rolled over.

A military coup will NEVER happen, now that Obama has “purged” the Military of top Generals for unknown reasons; but most likely because they either criticised him, or his policies, or refused to go along with those policies. Because of this purge, I don’t believe our military will do anything to stop this dictator.

Those plans are “grandfathered.” But following that guarantee is a list of costly requirements that made it difficult for insurers to keep offering your plan.

The insurance plan that I had (and that I liked) did not cover the adult children of policy holders. It also had lifetime coverage limits which helped keep premiums down. On January 1, 2011, I lost that plan. The Affordable Care Act (Obamacare) deemed my plan 'illegal'. The Obama government declared at the point of a gun to my insurer that they were no longer allowed to offer that policy - the policy I had, and the policy I liked - to me any more. Instead, the Obama government took it upon themselves to make changes to my policy, outlawing the policy that I liked, and replacing it with a policy that I did not like.

It gets worse. Union plans were “grandfathered” with none of those fine print tricks and exceptions [Sec. 1251(d)].

This in of itself violates the equal protection clause of Amendment XIV. But then Democrats have been opposing equal protection since 1828.

Oh, as an evangelical Post-Millenialist, I have the faith that our Sovereign God gives, that His Kingdom is expanding to eventually cover the entire world, thus Socialism, and Islam is eventually doomed, all knees, (including Obama) will bow to the Lord Jesus Christ.
Yet; in regard to THIS present moment, since Obama has purged the top leadership of the Military of those who would oppose him..if a military coup is to take place at all, it would have to be instigated by lower level officers..but it’s highly doubtful that this would ever happen, since the military is trained not to question orders that come down from the chain of command.

An individual soldier in the Military will follow orders, regardless.. It’s tough to see if any individual soldier will be able to determine if any orders are illegal or legal. That soldier will do as he is told. His IMMEDIATE officers will likely be the people who determine if the orders that come down the chain of command are legal or not. But as I’ve said, Obama has purged not only Generals, but flag officers as well.
I would love to see a Military coup occur, if that coup eliminates the Obama Administration, to replace it with a strict Constitutionally oriented Government. BUT at this present moment, this is not likely to happen. I just don’t see it happening.
