There is a requirement for controversy between a state and the federal government to be resolved by legal means at the supreme court. The insurrection didn’t do that, rather they started shooting.
Only after the war was it ajudicated. The insurrection lost that one too.
There is Article 3 which requires controversies between states and the federal government to be resolved by law with the supreme court as original jurisdiction.
Since the states did not avail itself of the available and necessary means to peacefully resolve any controversy that they had identified, they were in insurrection.
