BTW there are 4 different Court cases challenging the authority of the IRS to levy any ACA fines at all in the 36 States that do not have “State Exchanges” set up and are using the “Federal Exchange”.

Also, I have asked my Congressman, Mike Pompeo, and one of my Senators, Pat Roberts, to please ask Sebelius and others during hearings;
“Why don't we allow paper application to qualify for the ACA tax credits, for those willing to wait until tax time to receive and credit or subsidy? Why must we force everyone to use the electronic online Exchange, Why not let them deal directly with the insurance companies?”

I have also advised them it would be a BAD idea to pass enabling legislation on this point, as the 4 Federal Court Cases might well decide that the Federal Exchanges can NOT grant subsidies or credits or penalties at all.

This is DIFFERENT
and you have NEVER “seen” an ACA tax levy.
And, unless the law changes, YOU WON'T!
The ACA specifically FORBIDS the IRS enforcement that you insist it has!
The IRS agents are intended to prevent FRAUD, to prevent under reporting of income to receive massive, undeserved subsidies or credits!

YES, FRAUD can be punished in CRIMINAL COURT!

But, tell the truth about your income and REFUND any money that you claimed in ill-gotten or underserved subsidies, and you will be fine!

I do not mind “know it alls” if they really know their facts, but you are misleading many people here, without doing your homework.

DO YOUR HOMEWORK and get back to us, ok?

If this mess stays in force it won’t matter anyway in the long run. It is designed to insure that there will be NO REAL HEALTH CARE FOR ANYONE. There will be a pretense of health care but you will have better odds of staying healthy by just doing everything you can to prevent illness. As for trauma care, good luck.

Well for the record, I HOPE you are right. I personally have coverage so I don’t have to worry about this (just yet anyway). I’m not trying to mislead anyone, but do you honestly think Obama’s IRS will follow the law, when push comes to shove? Hell, he might just change the law by Executive Order. Wouldn’t be the first time.

RipSawyer, I think you are right. Another reason not to buy the “coverage” is that if you have a medical problem that requires expensive treatment — after you pay your $6K deductible — you are not likely to get treatment approval unless you are a registered Democrat. (Compare IRS targeting of Tea Party.) Any Republicans or Independents who buy “coverage” are likely paying for nothing. In essence Obamacare is a wealth transfer scheme.

Please, by all means. Go ahead and short the IRS that money on April 15th. Just like they can’t record all of your phone calls without a warrant. Just like you’re secure in your person and papers. Just like your right to keep and bear arms shall not be infringed. Be an example to everyone else that the government stopped operating under the constitution a long, long time ago.

You are WRONG!

Do you feel better now?

The point I made is correct: the IRS CANNOT attach leins, garnish paychecks, seize bank accounts or otherwise go after someone for NOT having health care insurance if they do not have a refund coming.

The WORST thing the IRS can do is subtract the fine from any refund due.

So who's wrong?

BTW: The IRS hasn't even developed the FORM yet according to a recent Washington Post article. In fact, the IRS doesn't even know what they can/cannot do to anyone who refuses to fill in the line on the 1040 or fill out the form that doesn't even exist yet.

So who's wrong? YOU ARE! (there, I feel better now.)

Wow. I guess all those silly people who had their bank accounts frozen by the IRS just on the word of the IRS for whatever reason the IRS made up were just imagining that it happened. It’s not like they had to pay the tax...they just had all their money seized until they paid it.

Your premise is the government will follow the law, mine is that it will not.

Your belief that if taken to court, the “justice” system will follow and interpret the law, my contention is that it will not. Courts are packed with activate judges you know.

So study all you want, reality is different. good luck to you and let us all know how the IRS treats you when they come for their money.

If there are any loopholes that can be exploited by regular Americans then you can bet they'll be found out and closed.

I don't suspect I'll be living in this country a whole lot longer under there circumstances. I'm already starting to learn Spanish in preparation for the "big move".

I'm not sure I follow:

"SS Edmund Fitzgerald was an American Great Lakes freighter that sank in a Lake Superior storm on November 10, 1975, with the loss of the entire crew of 29. It matters not, regardless of all the people here who said the IRS can or the IRS can’t enforce the fine/tax/tribute to king O’slimball.

I cannot believe people are hung up on what the law states regarding the IRS after our liar of a President has unilaterally changed the “law of the land” on more than one occasion.

The communist democrats keep telling us CACA © (Can’t Afford Care Act) is the “law of the land” yet one grossly inferior human being, Obama, continues to make unconstitutional changes to that law.

So folks, get off your high horses regarding if the IRS can or can’t enforce this as the Red Diaper Muslim Manchurian candidate can change this at a moment’s notice. What was passed by congress is no longer the CACA © that is currently in force and changed by 17,000+ pages of regulations and president ordered exemptions to all his communist buddies.

You are fighting with each other all while our real enemy still occupies the White House and controls the Senate.

Finally, remember the insidious Cloward & Piven plan is at work here where CACA © will be so bad, it will collapse the HC insurance industry and the people will demand Washington do something. And just like hope and change, the filthy vermin low/no information voters in this country will not give a damn what that something is and Obama and his communist progressives will have won.

Obama voters get refunds, and they can’t change their W-2 withholding not to, because they don’t pay taxes.

Every January they all get gleeful about their “tax-return”, which isn’t a refund at all, but rather an “earned income” welfare check.

So you average communisti voter making 20k selling beaded thongs, will start having their yearly welfare check reduced. That should be fun to listen to.
