State insurance chief doubts Obama's health care plan (Pennsylvania)

The state Insurance commissioner cast doubt Friday on a plan by President Obama to stop insurers from dumping more than 250,000 Pennsylvanians whose medical coverage did not meet the minimum requirements of the new health care law.

Insurance Commissioner Michael Consedine questioned whether Obama had the legal authority to allow insurers to reinstate or extend those policies. He also said the state has limited power to force insurers to comply with a scheme that he said “heightens confusion” surrounding the law's implementation.

“I think there are very fair questions being raised about the legal authority for the president to say we're going to ignore what's in the” Affordable Care Act, Consedine told the Tribune-Review....

Additionally, there are concerns among insurers about potential liability of selling health plans to consumers that violate federal law, the commissioner said.

Good to see the industry acknowledging that.

Are you keeping track of the States so far not wanting to participate? So far I think — Wash State, Rhode Island, D.C., Arkansas and Penn questioning it - Right? Any State so far going for it?

I suspect Landreiu and Feinstein know Obama can't just do a fiat which is why they're going the legislative route.

New York, believe it or not, is up in the air, as is Maryland.

“In some of these states it may actually be against state law to implement the president’s proposal,” says Sabrina Corlette, a research professor at Georgetown University’s Center on Health Insurance Reforms.

Corlette says several states — some put the number at around a dozen — have basically written the Affordable Care Act’s requirements into their own state laws. But it also means that starting Jan. 1, 2014, even if the federal government says canceled plans can continue for another year, state regulators might find their hands tied by their own state laws.

Indeed, Corlette says eight states have already moved to prevent or restrict insurers from renewing plans now that extend into 2014. That’s something the federal law does not prevent.

Go here to hear Jamie Dupree on Herman Cain on 11/14/13 regarding the authority to change the law as passed. It’s a 12 minute segment and Jamie covers the authority given by congress to the president or administration to administer “transitional” changes without legislation at the very end - 11:13-14 mark.

HA! They gave him the authority but they didn’t know it because they didn’t have a clue what was in the bill to begin with.

Seems like several state insurance commissions are not taking the bait. They have sense enough to know that extending plans that fail the Obamacare standards are now illegal.

Obama needs them and the insurance companies, so he will have someone to blame when this grand idea falls apart.

States don't want to be the ones holding the bag when the lawsuits begin. The know this latest Obama offering is wrought with unintended consequences.

Talk about opening a can of worms. Obama's attempt at a do-over is turning into as much of a disaster as the healthcare.gov website fiasco.

Pelosi was on record late in the week of preferring the administrative route.
