Oregon violated laws by allowing health plans to be extended, according to legislative lawyers

The Oregon Legislature'€™s lawyers think the state erred when it allowed insurers to extend health plans set to expire this year under the provisions of the Affordable Care Act.

More than 140,000 Oregonians faced Dec. 31 cancellations of their health insurance until Oregon Insurance Commissioner Laura Cali announced that insurers could extend those policies until the end of next year.

Rep. Dennis Richardson, R-Central Point, asked the office of Legislative Counsel to review that decision, and they found it violated the law.

"We're adding chaos upon dysfunction," said Richardson, who is running for governor.

Critics of the health care law have hammered President Barack Obama and other Democrats for claiming that Americans would be able to keep their insurance plans under the new law, even though a small subset of consumers have plans that don't meet minimum standards under the law and were set for cancellations.

Obama offered up a plan to extend those policies into next year and roughly half the states, like Oregon, have implemented it.

In a Dec. 2 opinion, Lorey Freeman, Senior Deputy Legislative Counsel wrote that allowing the extension essentially allowed companies to renew those policies in violation of federal and state law.

"The commissioner's announcement that she will allow all health benefit plans that were in effect on Oct. 1, 2013 to continue through the end of 2014 allows noncompliant plans to continue for up to 12 months longer than the ACA allows," Freeman wrote. "Therefore, we believe the commissioner exceeded her legal authority."(continued)

What do meaningless things like LAWS have to do with standing in the way of Obama and the Radical Academic Socialists “Shining Path” now?

Democrats can just ignore any law they choose to now, and be cheered for it by a willing media.

They realize that the democrats are screwed unless they somehow can stop cancellations until November. I live in Oregon, cancel away! Hopefully the libtards here will open their eyes.

They STILL have to be notified of their cancelations months in advance....I never looked forward to getting older than I do Nov 2014.

Exactly they had crappy policies before but now under the ACA they were going to have bright shiny new super policies and now they are trying to keep them on those crappy policies for another year. Just like all those crappy business policies which millions more will have to scrape by on until next year too. /s

Is there suppose to be some sanction or jeopardy for doing this?

I don’t think there is and they get paid to litigate this stuff in court...just to see what happens.

No fines ir jail. Hence no reason that regulates their behavior.

ObamaCare’s funding was predicated on all of those people spending more on insurance; how is ObamaCare funded if these people aren’t “kicking in” to the pot (along with the young people who don’t want to be charged for the new plans)?

Ah - the new meme... The truth is that most plans are "substandard", and therefore would be cancelled (from what I understand). The remaining plans are subject to the cadillac tax for being too generous.

This is a drop in the bucket to what is coming.

Wait until the Corporate policies are cancelled, and then the Government policies.

The fact is that every person in the United States with a health insurance policy has a policy that is not compliant with Obamacare and that policy will be canceled.

There is only one way to slow this clusterphuck down and that is to toss it in the garbage and allow or require the insurance companies to re-issue the policies they canceled.

Even that would hurt, but better that hurt than 250 million Americans being tossed into this bag of sh*t.
