SANTA FE, N.M. (AP) New Mexico's highest court has legalized same-sex marriage, declaring it is unconstitutional to deny a marriage license to gay and lesbian couples.
The state Supreme Court issued its ruling Thursday. New Mexico joins 16 states and the District of Columbia in allowing gay marriage.
Eight of the state's 33 counties have started issuing marriage licenses to same-sex couples since August, when a county clerk in southern New Mexico independently decided to allow the unions.

“Unconstitutional.” The word hasn’t had any actual meaning since FDR took over.
If only the Constitution were the actual measuring stick these judges used nowadays.
This is insane judicial tyranny!
Homosexual “marriage” stinks.
courts should not be able to make law
They do it because they can.
As long as the majority of Americans sit around watching reality TV and the Superbowl while their country goes to hell in a handbaske, these idiots will go on and on with this crap.
Not until people rise up and force this garbage to stop will it end.
Didnt make it legal, instead forced it on the state.
What is unconstitutional about it? That it treats American differently time for us taxpayers to sue as we are treated differently by different rates and we are treated differenly because we pay while other Americans are given our stuff?
Time for the taxpayers to sue.
“New Mexico’s highest court has legalized same-sex marriage, declaring it is unconstitutional to deny a marriage license to gay and lesbian couples.”
Then tell us whom CAN you deny it to. And then spin us some BS as to why THAT is ok.
They will be pushing incest next. Who is to say that two (or more) consenting adults shouldn’t do what they want in the privacy of their own bedroom? Slippery slope indeed.
IIRC, NM was the one state that had not legislated on marriage, one way or the other, since the AK and HI situations in the late ‘90s made the possibility of same-sex marriage salient. I’m sure NM Republicans said “we don’t need to amend the state constitution, since such a lawsuit would never succeed here”; just like those idiot GOP members of Congress who refused to push for a Federal Marriage Amendment around 2003, when clearly we had 2/3 of votes for passage in both houses of Congress and would have gotten 38 state legislatures to approve. “We don’t need that; we’ve got DOMA.” Famous last words.
remeber John McCain attached the poison pill “flag burning amendment” in order to kill the FMA.
Now, now. We all know that the constitution explicitly says that marriage is between 2 men, one woman, an oak tree, and a donkey named Bob. (/s)
A court can’t “legalize” anything. That is constitutionally the work of the legislature.
marriage is the union of one man and one woman period— NO State has ever documented any compelling State interest to advocate SODOMY and Fornication. If marriage means NOTHING to theState— I expect the Marriage rate to drop -as it has in Europe where such sin is encouraged.
From the New Mexican:
News of the ruling, which comes after a number of county clerks in the state already started issuing marriage licenses to same-sex couples earlier this year, spread quickly on social media and touched off celebrations among marriage-equality advocates, who plan a 6 p.m. rally tonight outside the Supreme Court building in Santa Fe.

Sadly, NM has been taken over by fleeing Californians who brought their absurd voting habits.
We conclude that although none of New Mexicos marriage statutes specifically prohibit same-gender marriages, when read as a whole, the statutes have the effect of precluding same-gender couples from marrying and benefitting from the rights, protections, and responsibilities that flow from a civil marriage. Same-gender couples who wish to enter into a civil marriage with another person of their choice and to the exclusion of all others are similarly situated to opposite-gender couples who want to do the same, yet they are treated differently. Because same-gender couples (whether lesbian, gay, bisexual, or transgender, hereinafter LGBT) are a discrete group which has been subjected to a history of discrimination and violence, and which has inadequate political power to protect itself from such treatment, the classification at issue must withstand intermediate scrutiny to be constitutional. Accordingly, New Mexico may neither constitutionally deny same-gender couples the right to marry nor deprive them of the rights, protections, and responsibilities of marriage laws, unless the proponents of the legislationthe opponents of same-gender marriageprove that the discrimination caused by the legislation is substantially related to an important government interest. BOLD = B.S. -- it is proponents of traditional marriage whose rights are being trampled!
The vote of the five Justices was unanimous.
Sodomy holds forth in Santa Fe (AKA San Francisco of the east).
New Mexico is a liberal state - hippies and hispanics. I’m surprised it took this long.
New Mexico will mow infect Texas as gay Texans can run across the border, get married, come back home to Texas and live as a married couple under the protection of the SCOTUS DOMA decision.
How can we work this decision into getting concealed carry permits?
All these tyrants have done is destroy the meaning of the word “marriage”. There is no such thing as homosexual marriage and the idea of it is absurd. Next we’ll hear that wanting to diddle somebody in the nose is just another way of loving. Barf.
Just because the AZ Supreme Court ruled it legal, there are ways to overturn this decision, just like if the US Supreme Court rules in a decision, it too can be overturned.
A supreme court decision is not the absolute rule of law forever!
Step One: Approve homosexual marriage
Final Step: Lower the age of sexual consent.
That IS coming SOONER than you think and IS the homosexual community actual goal.
The homo crowd want to bugger our children and they will do in the cover of schools claiming : Sexual Exploration/Education
Who are these warped and twisted lawyers in black robes who believe that men and women are interchangeable? Have they never taken biology? Do they understand natural law? Are they morons and dregs?
One thing is certain. They are not alone.
Many if not most people know that men and women are not the same, but are very different and complementary. Men and women are NOT interchangeable, no matter how many laws are passed saying otherwise!
The country itself will end first.
Welcome to the final Babylon.
“Sodomy holds forth in Santa Fe (AKA San Francisco of the east).”
Yeah, Santa Fe has always been a blight on the state. I grew up north of Santa Fe, and always hated driving into town. Never felt that I would come away unscathed...
Moved out to Oklahoma in the early ‘80s and never looked back. And New Mexico has gotten worse over the years.
Loved the land/climate and some of the people, but could do without Santa Fe, Taos, and Albuquerque.
We are living in parallel cultures. At this point it looks like we have irreconcilable differences. Best to establish our firewall and leave them to their fate.
Not following you here...
Santa Fe is the SF of “the east?”
NM is now in the east?
Well it is east of San Francisco... I think that is what the original poster meant. And I cannot think of any other city east of San Fran that is like San Fran, other than Santa Fe...
Yes that is what I meant. I lived there for 13 years starting in the late 1970's. At that time there were more similarities than differences. Of course, back then San Francisco didn't have the gay sodomite in-your-face culture that it has now, and Santa Fe still doesn't. But even back then, the gay culture in Santa Fe was well established and openly seen especially in restaurants and shops. And the leftwing radical views of politicians are the same from being a sanctuary city for illegals, to complete support of Rat policies, and support for far left environmental causes including solid and fluid mineral extraction, logging, endangered species and of course global warming.
From Yahoo Answers:
I'd say that Santa Fe is probably the *most* gay-friendly. I know a lot of gay people who have moved from Albuquerque to live in Santa Fe because they felt more at home.
Growing up I've often heard people refer to Santa Fe as a mini San Francisco, and actually that's true. When it comes to the percentage of same-sex households, Santa Fe is 2nd right behind San Francisco.
The same thing Kennedy and Roberts will do to the rest of the country the first time queer “marriage” is heard before the court. Only a matter of time. The justices appointed by democrats can’t get it done, so the two republican judges will help them out.
How many naturally conservative Hispanics are outraged at this decision?
It seems it is not a big deal to Hispanic voters.
HA, I see you just had to stick Roberts in there just because you are mad about Obamacare.
Except Roberts didnt join Kennedy on the gay cases, he stuck with Scalia and Thomas on those. Gay issues are not Obamacare issues.
Kennedy has been making up new gay rights for a long time, he helped rule to make same-sex sodomy a constitutional right under GWB era.
The New Mexico Supreme Court “justices” are an example of the failure of out public educational system. The fact is, there WAS no discrimination! The same rules applied to EVERYONE!
“Except Roberts didnt join Kennedy on the gay cases, he stuck with Scalia and Thomas on those. Gay issues are not Obamacare issues”.
Roberts got his first cousin, a lesbian who has “married” her girlfriend to the DOMA hearings. The cousin said before the hearing that she was certain that Roberts would rule in “her” favor. She was disappointed that the Supreme Court didn’t completely throw DOMA out the door. She said afterwords that she was certain that when the case of homosexual “marriage” comes before the court that her cousin (Roberts) will make the family proud and say no one can be denied the right to marry someone. The rumors about Roberts have been around for years.
I will have to repeat:
“Except Roberts didnt join Kennedy on the gay cases, he stuck with Scalia and Thomas on those.”
He voted against the two gay rights rulings. That is a fact.
The fact that his gay relative was disappointed that he ruled against her, as you pointed out, that only makes your claims look more silly.
Unconstitutional. The word hasnt had any actual meaning since FDR took over. Actually, unconstitutional actions have been taking place FROM DAY ONE, ONWARDS! If, only, there was a way to keep track of all unconstitutional actions, by everybody, 100%!
It appears that NM has experienced what PA did in the 80’s.
The great exodus of Leftists from Noo Yawk and Joisey crossed the Delaware like illegals crossing the Rio Grande. They brought demands for their Socialist lifestyles, along with higher taxes and Leftist laws.
As a result, PA went Left and never looked back.
Claiming that "same-gender couples are as capable of responsible procreation as are opposite-gender couples," the N.M. Supreme Court ...
This judge now has to redefine 17 words in the dictionary:
Webster`s definitions of marriage and procreate show that "procreate" is between a father and a mother, not a male and another male or between 2 females:
Webster`s 1887 Dictionary
to procreate = to generate or produce; to beget
generate: to beget, to produce
reproduction: the process by which plants and animals give rise to OFFSPRING,... ordinary sexual reproduction involves the fusion or union of two sex or germ cells, one, the egg, derived from the female parent, and the other, the sperm, or spermatazoon, from the male parent. From the cell thus produced (the fertilized egg) the OFFSPRING develops."
to beget: to procreate as a SIRE
sire= a male progenitor; father
progenitor: an ancestor in the direct line; a forefather
offspring= child, children
father= one who has BEGOTTEN; a male PARENT
parent: one who begets or brings forth OFFSPRING; a FATHER or a MOTHER
mother-= female parent
marriage= "state of being married; also the mutual relationship of a husband and wife; WEDLOCK; the social institution whereby MEN and WOMEN are joined in a special kind of social and legal dependence for THE PURPOSE OF FOUNDING AND maintaining a FAMILY"
family= those descended form a common progenitor; a group comprising immediate KINDRED; especially THE GROUP FORMED of PARENTS and CHILDREN"
wedlock= betrothal [always involved the MAN giving the WOMAN a RING [used to be a ring of iron [it started in Roman law, later adopted by Christianity] to show the seriousness of the troth [truth]
engagement- to pledge in marriage; betroth
KINDRED=related to each other; COGNATE
cognate= allied by BLOOD; especially on the MOTHER`s side
The “Judges” are addle-brained.
These “judges” are not critical thinkers. There is NOTHING discriminatory about hetero-sexual marriage being the only one allowed. The same laws apply to BOTH straights and gays. Two straight men can’t marry, any more than two gay ones can. Any man, straight or gay, can marry any woman he can talk into it. The SAME rules apply to all. And the same for females.
