What is unconstitutional about it? That it treats American differently time for us taxpayers to sue as we are treated differently by different rates and we are treated differenly because we pay while other Americans are given our stuff?

Time for the taxpayers to sue.

IIRC, NM was the one state that had not legislated on marriage, one way or the other, since the AK and HI situations in the late ‘90s made the possibility of same-sex marriage salient. I’m sure NM Republicans said “we don’t need to amend the state constitution, since such a lawsuit would never succeed here”; just like those idiot GOP members of Congress who refused to push for a Federal Marriage Amendment around 2003, when clearly we had 2/3 of votes for passage in both houses of Congress and would have gotten 38 state legislatures to approve. “We don’t need that; we’ve got DOMA.” Famous last words.

We conclude that although none of New Mexico’s marriage statutes specifically prohibit same-gender marriages, when read as a whole, the statutes have the effect of precluding same-gender couples from marrying and benefitting from the rights, protections, and responsibilities that flow from a civil marriage. Same-gender couples who wish to enter into a civil marriage with another person of their choice and to the exclusion of all others are similarly situated to opposite-gender couples who want to do the same, yet they are treated differently. Because same-gender couples (whether lesbian, gay, bisexual, or transgender, hereinafter “LGBT”) are a discrete group which has been subjected to a history of discrimination and violence, and which has inadequate political power to protect itself from such treatment, the classification at issue must withstand intermediate scrutiny to be constitutional. Accordingly, New Mexico may neither constitutionally deny same-gender couples the right to marry nor deprive them of the rights, protections, and responsibilities of marriage laws, unless the proponents of the legislation—the opponents of same-gender marriage—prove that the discrimination caused by the legislation is “substantially related to an important government interest.” Breen v. Carlsbad Mun. Sch., 2005-NMSC-028, ¶ 13, 138 N.M. 331, 120 P.3d 413 (internal quotation marks and citation omitted).

Just because the AZ Supreme Court ruled it legal, there are ways to overturn this decision, just like if the US Supreme Court rules in a decision, it too can be overturned.

A supreme court decision is not the absolute rule of law forever!

Who are these warped and twisted lawyers in black robes who believe that men and women are interchangeable? Have they never taken biology? Do they understand natural law? Are they morons and dregs?

One thing is certain. They are not alone.

Many if not most people know that men and women are not the same, but are very different and complementary. Men and women are NOT interchangeable, no matter how many laws are passed saying otherwise!

Yeah, Santa Fe has always been a blight on the state. I grew up north of Santa Fe, and always hated driving into town. Never felt that I would come away unscathed...

Moved out to Oklahoma in the early ‘80s and never looked back. And New Mexico has gotten worse over the years.

Loved the land/climate and some of the people, but could do without Santa Fe, Taos, and Albuquerque.

Yes that is what I meant. I lived there for 13 years starting in the late 1970's. At that time there were more similarities than differences. Of course, back then San Francisco didn't have the gay sodomite in-your-face culture that it has now, and Santa Fe still doesn't. But even back then, the gay culture in Santa Fe was well established and openly seen especially in restaurants and shops. And the leftwing radical views of politicians are the same from being a sanctuary city for illegals, to complete support of Rat policies, and support for far left environmental causes including solid and fluid mineral extraction, logging, endangered species and of course global warming.

I'd say that Santa Fe is probably the *most* gay-friendly. I know a lot of gay people who have moved from Albuquerque to live in Santa Fe because they felt more at home.
Growing up I've often heard people refer to Santa Fe as a mini San Francisco, and actually that's true. When it comes to the percentage of same-sex households, Santa Fe is 2nd right behind San Francisco.

HA, I see you just had to stick Roberts in there just because you are mad about Obamacare.

Except Roberts didnt join Kennedy on the gay cases, he stuck with Scalia and Thomas on those. Gay issues are not Obamacare issues.

Kennedy has been making up new gay rights for a long time, he helped rule to make same-sex sodomy a constitutional right under GWB era.

Roberts got his first cousin, a lesbian who has “married” her girlfriend to the DOMA hearings. The cousin said before the hearing that she was certain that Roberts would rule in “her” favor. She was disappointed that the Supreme Court didn’t completely throw DOMA out the door. She said afterwords that she was certain that when the case of homosexual “marriage” comes before the court that her cousin (Roberts) will make the family proud and say no one can be denied the right to marry someone. The rumors about Roberts have been around for years.

The fact that his gay relative was disappointed that he ruled against her, as you pointed out, that only makes your claims look more silly.

It appears that NM has experienced what PA did in the 80’s.

The great exodus of Leftists from Noo Yawk and Joisey crossed the Delaware like illegals crossing the Rio Grande. They brought demands for their Socialist lifestyles, along with higher taxes and Leftist laws.

These “judges” are not critical thinkers. There is NOTHING discriminatory about hetero-sexual marriage being the only one allowed. The same laws apply to BOTH straights and gays. Two straight men can’t marry, any more than two gay ones can. Any man, straight or gay, can marry any woman he can talk into it. The SAME rules apply to all. And the same for females.
