The difference between high explosives and low explosives is that low explosives must be contained in order to explode.
Gun powder is a low explosive because if you just pour a trail of gunpowder in a line across a sidewalk and light it, the gunpowder will burn instead of explode...but if you wrap gunpowder inside a container such as for a firework, it will explode instead of simply burn.
In contrast, high explosives need no container in order to explode. C4 is a high explosive. Nitroglycerin is a high explosive.
The ATF doesn’t determine what is high or low...that’s the role of physics to decide.
If flash powder blows up without being in a container, then it is a high explosive. If not, then it is a low explosive.

In this case, they did. Check the regulations, it has nothing to do with physics. Their reasoning was, since flash powder is responsible for most explosives injuries, it “needed regulation” so they declared it to be HE, for the purposes of controlling it.
