EPA overrides Congress, hands over town to Indian tribes

Have you heard the story of the residents of Riverton, Wyo.? One day they were Wyomingans, the next they were members of the Wind River tribes — after the Environmental Protection Agency declared the town part of the Wind River Indian Reservation, undoing a 1905 law passed by Congress and angering state officials.

The surprise decision was made by officials of the EPA, the Department of Interior, and Department of Justice early last month, and has invoked the ire of Gov. Matt Mead, who has vowed not to honor the agency’s decision and is preparing to fight in court.

“My deep concern is about an administrative agency of the federal government altering a state’s boundary and going against over 100 years of history and law,” Mead said in a statement. “This should be a concern to all citizens because, if the EPA can unilaterally take land away from a state, where will it stop?”

The EPA declared that Riverton was part of the Wind River Indian Reservation after granting a “Treatment as a State” application from the Northern Arapaho and Eastern Shoshone tribes. The tribes submit such applications to get funding for air quality monitoring under the Clean Air Act. However, this seemingly innocuous application ended up undoing the tribal boundaries set by a 1905 congressional act.

The EPA granted the tribes’ claim that the Wind River reservation extended over one million acres of land beyond what the 1905 Congressional Act established. By doing this, the agency effectively overruled an act of Congress, state officials charge.

Ah yes, the EPA has been taking away land from property owners by telling them what they can and can’t do with it, now it’s only logical they start taking away land from states.

Eliminate the EPA...Now!

Well, typical of this anything-goes administration.

I guess liberals will love it because it is the tit for tat which American Indians “were long deserving.”

I dunno. The whole idea of someone like American Indians deserving reservations after a conquest of their land is something that Enlightened White Men dreamed up. They’d best be careful about biting the Hand That Has Been Feeding Them.

And anyhow. What would happen to the town would be a tragic joke. If this doesn’t get court overruled, which AFAIK it still probably will.

Now let’s suppose oil or gas is discovered on this land. Who wants to bet that no drilling will happen. The EPA in effect just put this land off limits to any productive use.

I fail to find Constitutional Authorization for the EPA, much less the authorization for such an agency to overturn the law and give private property to another soverign entity.

This unConstitutional Act must be overturned.

I reckon you haven’t heard of the Riverton Dome. There is extensive oil and gas development in the area, and the Tribes have a royalty interest in many of the wells. I worked a couple of wells in the area for ARCO in the early ‘90s.

That sure sounds an awful lot like an excuse. I hear that a lot lately. In fact, I hear excuses every time the GOP allows crap like this to happen.

First, God isn’t going to appear and fix this. I wish he would, but he isn’t. Accept it.

Second, WE made the mess by empowering the liberalization of the GOP. Accept it.

Third, if you want to make this a religious issue every time the GOP does either nothing or the wrong thing, I’d ask if you prefer working towards purity or CONTINUING to empower corruption.

does that mean the residents no longer have to pay federal or state taxes? do they now get the ability to open casinos, if they are ‘natives’ of the reservation by being born there?

I’d say there’s prolly more up side then down side to this blunder

You fundamentally misunderstand, and the only excuse here seems to be yours.

I think of last time around in the presidential primaries. Newt Gingrich. He had gotten serious enough in his faith life to switch churches because of a tie he believed it had to God. Now to me — and I will robustly stand up for Baptist practice in the main, with a few quibbles — that says more important than what church it was (he went from Baptist to Catholic).

But oh, the pissing and moaning over Gingrich’s past miscues and flirtations that went on. He ended up getting passed over for the even spiritually weaker Mitt Romney, and a last minute rally failed to overcome the foxy Democrat ballot stuffing.

Man, wouldn’t you give almost anything to have a President Gingrich right now? Whatever you can fault him for, shyness wasn’t it. He would likely not have faded after one obligatory stellar debate, trying to please everybody like Mitt did.

God is teaching us lessons. Will we listen? And yeah, “religion” if you must. Religion that doesn’t DO anything is a farce!

I would have loved Gingrich compared to most of the options there. But that isn’t the point. The point is that every time someone makes excuses for the GOPs mistakes and lack of action it further empowers them to move left and do more things like work all manner of anti christian, anti American leftism into the laws of the land. Which they have done at an increasingly rapid pace since Ronaldus shunted the presedential coil..

This is a VERY black and white issue since it was the grey matter that screwed it up to begin with. Or the lack of it’s use to be entirely accurate.

We are 10ish months out from an election. A couple/ish years out from the big one. Right now is the time to put your principles on display and let the idiots know that you won’t continue participating in your own demise. The alternative is to repeat the last election and be all hyperpatriot until you get skeered and cave in when it matters most.

This assumes of course that you (the general you/we) actually believe in what we go on sites like this and claim to.

you do or you do not. Black or white.

Simple choice for me.

Gingrich is a perfect illustration of my point.

He actually DID something recent, notable, and of personal consequence on account of God. Not too many of the politicians in the running did. Michelle Bachmann also did... she believed in “pray the gay away” enough to publicize it. (It really ought to be “pray the straight in,” but that’s a minor detail compared with what it says about her engagement with the Lord.) A President Bachmann would be quite peachy right now!

And each one of those was treated as just another dreary, compromising, and/or weak flash in the pan.

God has a lesson: “PAY ATTENTION, I AM YOUR VICTORY, YOU ARE NOT.”

No such authority exits by the agency’s to alter any state boundary. Gov Mead needs to just give them a big-fat middle finger and kick every federal agency out of the state and threaten to arrest any Federal Bureaucrat clown who as much as steps foot in Wyoming!

The black or white ought to be in whether that person has a faith of consequence in God.

George Washington himself might not have gotten the red carpet treatment if you’d really known the man from a worldly point of view. He was a hot head that strove valiantly to keep from losing his temper. He wouldn’t have said much, for fear of emotion carrying him away. He constantly studied bible verses on keeping an even temper. On the battlefield that was another story... being mad at the British was the perfect thing to carry him from battle to battle to battle, and the hardships refined his temperament. Blessedly, his founding father compatriots were fervently bible believers if not outright Christians and they knew where George was coming from. He got bubbled to the top, and we know the rest.
