Man killed by Yakima police was holding an airsoft gun
KIMATV ^ | January 6, 2014 | Ada Chong

New details have come to light in this weekend's deadly officer-involved shooting outside a Yakima car wash.

YPD said the officer shot and killed Rocendo Arias because he saw him holding a gun in his car. Arias took a bullet to the head.

Investigators said Yakima Police Officer Casey Gilette saw a suspicious car parked at a car wash. After noticing it hadn't moved for an hour, YPD said Gilette approached Rocendo Arias's car. First on the driver's side, then the passenger's side and opened the door. The officer told investigators he saw Arias holding a gun.

"It appeared that he had some accessories to the handgun that he was trying to install on it or put pieces of this gun together," said Yakima police Captain Rod Light.

Gilette shot four times, hitting Arias once in the head. YPD Spokesperson Rod Light maintains the officer had reason to react.

"The deceased had the weapon not only in his hand, but he also had his finger on the trigger," said Light.

However, investigators learned that Arias' weapon wasn't a typical gun. It was an Airsoft gun, considered a replica that shoots plastic pellets. While these guns can fire at high velocity, they're not designed to be lethal. YPD said it's not clear if Arias pointed the gun at Gilette before the shooting...

"The deceased had the weapon not only in his hand, but he also had his finger on the trigger"

Say what? The trigger of THE AIRSOFT GUN?

Execute first, ask questions later, I guess. Yes, it was 3am in the morning. Why didn't the officer call for backup if he was so concerned?

What was the reason for the confrontation? Just for the sake of confronting a peasant?

Don’t worry, the police will clear themselves of any wrongdoing.

I gave my Grand Son two airsoft guns for Christmas. They do look like the real thing from any distance but they also have a blaze orange ring around the muzzle which is very hard to not see.

“Based on the preliminary investigation, I absolutely stand behind the officer and his actions in the shooting that occurred,” Yakima Police Chief Dominic Rizzi told the Yakima Herald.

After all, the deceased was just a peasant...

Airsoft guns usually have an orange tip at the end of the barrel, which Captain Light confirmed.

“I believe this particular handgun had an orange tip," added Captain Light. "But based on our investigation I don’t want to go into particulars and details of the position of the gun and where the officer was. It was 3 a.m., it was dark and again we haven’t interviewed this officer yet and we don’t want to speculate."

Best not let any of The King's Men see your grandson with these dangerous weapons...

So once again the mere possession of a firearm is justification of a death sentence.

I have never understood the idea of painting the tip of an Airsoft Gun Orange.

If a Criminal wanted the Police to think he had an Airsoft Gun rather than a real Firearm, he could simply paint the tip of the Barrel Orange to gain the advantage over any Officer he might encounter while committing a Crime.

Maybe it’s me, but it just looks like Liberal Idiocy in practice.

Or the mere possession of something that LOOKS like a firearm. DEATH!!!

You get to yank open the peasant's car door, and cap him right there...

When a cop feels threatened by what appears to me a gun, he is trained to three tap center mass. Lesson learned, don’t threaten a cop with a weapon that appears to be a real gun.

Unless you are brandishing one in your own vehicle in view of a cop, then it is lethal- to you.

Four shots, three misses. One in the head. Probably shot the kid in the head out of final frustration, and to remove any witnesses.

Lesson learned, don’t threaten a cop with a weapon that appears to be a real gun.

The kid didn't threaten the cop. He was apparently trying to fix a broken Airsoft gun, and it probably didn't cross his mind that a) his Airsoft gun was for pointing at someone, and b) it's the death penalty for sitting in your car, going about your own business.

If you see someone with a gun you just shoot them. Sounds like second degree murder to me.

Well, the peasant wasn't lying on his belly, with his hands cuffed behind his back, bleeding out, and Officer Friendly wasn't standing on the back of his head to force a little pavement ingestion.

So, you can see how the officer might have felt threatened.

He might have even "feared for his life!"

And "worried about going home safe!".

It's all good. The peasant is safely planted.

I have thought about that too.

Eventually I decided that nearly all criminals want you to know it is a real gun. If they are using it to threaten you then they don’t want you to think it is a fake.

If they are shooting at someone then you know it is not a toy.

First of all, whether he had his finger on the trigger is not something that any cop wants to take a chance on, a gun pointed is a gun that could cause an officer to be buried by his peers. Second of all, I have over 33 years in law enforcement and know something about being in this officers situation, Chief.

Like you, I will wait for the final verdict before commenting any deeper.

Why wait for all the facts?

You have already made an assumption which I think is very unlikely. Why would the guy point a plastic toy at a cop? I guess it is possible that he didn’t know it was a cop who jerked his door open. Then he might have pointed his plastic toy hoping to ward off the robber or car jacker.

Gee. Wonder why? So the cop surveiled the guy for over an hour. He's not doing anything that could be considered criminal so he goes over and sees the guy screwing with a gun that's not even pointed at him and he pops the guy?

BS.

Also what if it was a private security officer that was responding to page from a faulty alarm system, he gets done responding to it and goes back to his car and notices that his gun took some damage when he dropped it trying to fix the disabled alarm, he is in his car with his gun messing with it then all of a sudden... blam blam blam blam... he is dead....

I did not assume anything. I mentioned several possible scenarios, none of which were stated as anything but a possibility.

You or someone else flat out stated that he pointed the gun at the cop with his finger on the trigger. Since the cop is the only living witness to the exact chain of events, then he can literally say anything he wants.

Yes cops lie. I have seen them lie through their teeth.

As my posting history will show, I have no love for the transformation of police and sheriff’s departments into ‘law enforcers ‘ who are armed hall monitors. However, your remarks are correct. Point something that looks like a real firearm at a Leo and a deadly response can be expected. Yakima is overrun with damp Americans, um, er, undocumented Americans or ‘economic refugees’ and as a result swarms with Latino thugs and gang members. I can understand why the LEO did what he did. In passing, I wonder what the ‘emigration status’ of the decent was?
