I agree that classifying sneakers as deadly weapons is pretty stupid. Now the heavy steel-clad boots I mentioned would make some sort of sense, particularly if the prosecution could show he put them on in preparation for the fight.
I don’t know about this case, but in many cases the jury is ordered to determine the facts, which in this case would be whether the shoes were weapons or not.
Obviously in the most technical sense, almost any object can be a deadly weapon. An OSS-trained WWII friend of the family once demonstrated how you can absolutely, positively kill someone using a ballpoint pen or a pencil.
And a trained or even untrained person can kill someone without any weapon at all.
They should at least ban shoes capable of holding more than 5 toes, aka Assault Nikes.
