“A couple of days ago a Freeeper posted that a cop in a different state did a license plate scan and it told the cop he had a carry permit.”

The guy needs to sue Maryland in Federal Court for violating the Firearms Owners Protection Act of 1986. That act provides for “safe passage” of non-residents passing through any other state irrespective of that state’s gun laws. I just don’t know how New York City gets away with arresting people passing through any of their airports given this law.

What would he sue for? You have to prove damages. How do you assign a monetary figure? At $5,000 down and $500/hour to operate the legal system it’s not worth getting a judgment for $1 and a court saying (maybe) that he’s right. He might actually end up paying the other side’s legal fees too, if he loses.

Does FOPA actually apply in that case since the firearm owner did not even have the aforementioned firearm in his possession at the time of the incident? Remember, the guy had left his handgun in his safe at home when the Maryland cop decided to go all Gestapo on him.
