Virginias chief lawyer said he wont defend the states law. Eight of his peers in other states could soon join him.
When Mark Herring, the attorney general of Virginia announced on Wednesday that the states ban on gay marriage was unconstitutional and that he will not defend the law in court, he was hailed by marriage equality activists as a hero.
Herring put a handful of his fellow attorneys general in a tough spot though. There are currently eight states that have some kind of law against same-sex marriage on the books and have a Democrat as the chief lawyer sworn to uphold their states laws and constitution.
With Herrings decisionand he joins that of fellow Democratic attorney general Kamala Harris of California, Kathleen Kane of Pennsylvania, and Lisa Madigan of Illinois who also decided not to defend the states marriage lawpressure is growing on the rest to come down on what advocates for marriage equality call the right side of history.

If a Republican State’s Attorney were to refuse to enforce gun laws, there would be hell to pay.
Of course, the oath he swore just a few or two back to support and defend the Virginia Constitution is irrelevant, due to the “mandate” from his 900-vote statewide victory.

You gotta love how the left uses language: “marriage equality.” Good grief.
Free speech means that they can say whatever they want but we must remain quiet. Only one point of view is allowed.
Democrats are infinitely flexible as they follow a feeling which they “know” to be correct. One problem is that the feeling they “know” to be correct conflicts with laws and it changes with the feeler and the fashion of moment. This is a perversion of the moral superiority which allowed Frank Kersey (”Death Wish”) to flout the law because God’s law was on his side.
One would hope that we could all live by man’s laws, which are (or, were) based on God’s laws. As I recall, the government (in “Death Wish”) had stopped enforcing men’s laws. So, the hero, Kersey, enforced God’s laws. (But, in each case, he only killed when he was attacked. He offered himself as a target.)
Everyone has equal rights when it comes to marriage. We can marry whoever we want with certain restrictions that apply to all. They must be of appropriate age. They must not be married. They must be of the opposite gender.
Well they don’t enforce immigration law and encourage so called “sanctuary cities’,they refuse to enforce the Defense of Marriage Act and enforce tax laws and regulations to the Nth degree against any Tea Party Group. We no longer have rule of law but rule by decree.

And the problem for our side is... when the AG refuses to defend the existing law... or in this case the amendment to the state’s constitution, anyone who steps up won’t be informed until the SCOTUS’ ruling that they don’t have “standing.”

This is what’s called anarchy; the laws do not matter anymore. Grounds for impeachment, every one of them. Where the hell are the legislators? Half of ‘em take it up the rear, no doubt.
Anything liberal; it will sell in VA; Jefferson was wrong in his hopes for the people of future VA.
