Franklin DUI officer found passed out in car at bar avoids arrest

FRANKLIN, Tenn. - A Franklin DUI officer is now the source of controversy after being accused of being drunk and passed out behind the wheel of his private vehicle in November.

Officer Brent Rose has since admitted to his mistakes and has been internally reprimanded by the Franklin Police Department; however, questions remain why he wasn't arrested and charged with DUI the night of the incident.

According to a police report, Rose drank multiple Jack Daniel's and Coke drinks at Losers Bar and Grille on the night of November 2 before driving to Tin Roof 2 around Midnight where he continued drinking on November 3.

The police report stated Rose does not remember what happened at Tin Roof 2 before he was discovered passed out in his vehicle in the exit turn lane near Carothers Parkway.

The report indicated the Rose's keys were in the ignition and the car's motor was still running. In Tennessee, it is illegal to be under the influence and behind the wheel of a motor vehicle, running or not, with the keys on your person.

Police reported that by Rose's own statements he indicated that he had been drinking alcoholic beverages for several hours. Officers also found a 32 ounce tumbler of alcohol in his car.

Franklin has changed some, but; Brentwood and Franklin are just south of Nashville. Franklin’s Police Dept is part of the “good ole boys” network.

In Alberta, very similar law. He was in the 'care and control' of a motor vehicle while intoxicated. Would have got 1 year license suspension, a criminal record, a fine of up to $10,000 and triple the car insurance premium.

In this case Rose should be singing Garth Brooks' old song I Got Friends in Low Places. That thin blue (hazy) line.

This reminds me of when I lived in Santa Barbara, California in the early to mid 1980’s.

A local off duty cop was driving drunk one night on Highway 101, the main link between L.A. and San Francisco.

Not only was this guy driving drunk, he was also yelling racial slurs at a car load of Asian people who were driving near him.

The cops pulled him over, and took him home to “sleep it off.” He was NOT arrested.

If it were you or me, we would have been locked up in the Santa Barbara County Jail and we would be facing a slew of charges.

I wonder how long it will be before everyone he arrested for drunk driving in the last two years will have their cases dropped. Six Hundred cases were recently dropped in Louisville Ky after corrections officers who administered breathalyzer testing were found to have expired training certifications. I can’t really see how the testimony of a drunken cop could hold much weight in court.

He is depressed and all the drunks he has arrested have been getting on his nerves and he is suffering from extreme depression.

Ass hat was never arrested. Never lost his precious freedom. Still has a job. This Officer was no .08 BAC. This Officer was not technically drunk. This Jerk was blind, stupid passed out drunk. Yet no arrest. No charges. Still has a job. Why? Officers have discretion we are told.

So how come so many people’s lives are ruined for being drunk, but only drunk in a technical, legally defined sense?

You people know who you are that defend the .08 BAC and roadblocks. You people make me physicaly ill that you would place so much power into the hands of a blindly self serving and stupid institution. Men cannot easily bear power yet you would clothe this stupid beast man in unyielding brutish authority. The stupidity of this arrangement is mind boggling.

In ND it is called "Actual Physical Control of a Motor Vehicle" while under the influence of alcohol. The penalties are roughly the same as for DUI.

The problem is that the guy heading home from the bar who realizes he is drunk can't just pull over and let the heater run in the winter without taking a serious chance of getting busted, so he tries to make it home...

If you have the keys in your possession, whether the vehicle is running or not, and you are drunk, parked, and in the vehicle, you can be charged.

I believe the initial intent was to keep people from evading the police long enough to park somewhere and thus avoid DUI charges.

The result had unanticipated consequences, keeping drivers on the road (taking a chance versus surely getting busted for Physical Control) in an effort to get home or someplace 'safe'. In winter, the inability to park, run the engine and stay warm would be all the more incentive to keep driving (here you can freeze to death).

We had a cop stopped for DUI he was driven home by higher ranking cop other than could’t take his car home for a couple of weeks nothing was done he is still on the force.

Neither do I, but those who enforce them should suffer full legal consequences when they violate those laws. Zero tolerance.

Same goes for the cops who covered for him.

It’s nice to know if I ever got caught I’d be hung out to dry, and this guy doesn’t have a thing happen except that they claim he had a stern talking to.

No surprises here. Many folks with problems gravitate to jobs that deal with the same problems. Racist femi-nazis become social service/actions counselors, nut cases become psychiatrists, drunks become DUI officers, fascists become Democrat candidates/politicians...
