Bachmann says House preparing to sue Obama for overreach: ‘He’s not a king’

WASHINGTON — Minnesota Rep. Michele Bachmann says House conservatives are preparing to sue President Barack Obama for executive overreach in response to his threats of unilateral action on a host of issues.

“He’s the president of the United States — he’s not a king,” the Republican lawmaker told reporters after Obama’s State of the Union address. “He may think he’s a king, he may declare himself king, but that’s not what he is under our Constitution.”

Bachmann said an effort is underway in Congress to take back their “authority under the Constitution as the House of Representatives.” She said the plan is to introduce legislation allowing lawmakers to hire an attorney, so “we can force the president to act under the Constitution.”

“We’ll sue the president of the United States and force him to no longer act unilaterally,” she said.

In his address at the Capitol Tuesday night, Obama said he plans to take unilateral action on the minimum wage for federal workers. He suggested he might go solo on guns, for example.

Pelosi threat to sue Bush over Iraq bill

House Speaker Nancy Pelosi (D-Calif.) is threatening to take President Bush to court if he issues a signing statement as a way of sidestepping a carefully crafted compromise Iraq war spending bill.

Pelosi recently told a group of liberal bloggers, “We can take the president to court” if he issues a signing statement, according to Kid Oakland, a blogger who covered Pelosi’s remarks for the liberal website dailykos.com.

A lawsuit could be seen as part of the Democrats’ larger political strategy to pressure — through a series of votes on funding the war — congressional Republicans to break with Bush over Iraq.

Lawmakers have tried to sue presidents in the past for taking what they consider to be illegal military action, but courts have rejected such suits.

Clinton avoided impeachment in the Senate for the lack of a Republican Majority. If the GOP can take the senate and house, and O’Fraudo lies under oath with proof- he’s dead meat.

I'm not sure so don't quote me but I thought the House impeaches and the Senate removes from office.

Like, I think, Clinton was impeached but not removed from office.

Punting? This action was taken by a few (underline few) representatives in the House. The House has repeatedly been beaten over the head with presidential vetoes and Senate refusals with their DemocRAT majority.

It is an excellent example of why 'elections have consequences'.

IIRC, it takes 67 Senate votes after the Senate trial to remove a sitting president, after the House impeaches.

I have posted before: If Obama gets impeached and subsequently removed, it will be the Dems leading the charge. And they are far from that currently.

Bachmann says Obama will have a fight ahead. “If he wants to go forward with his unilateral activity, he better be prepared for the lawsuit that the United States Congress will bring,” she said.

OK...maybe I'm not following the logic here...

The DOJ who would defend such a lawsuit is under the purview of the executive branch...and this would be heard in a federal court...eventually moving to the SCOTUS which is loath to get involved in federal separation disputes...

Eric Holder would probably ignore this legal action or SLOW walk this like a snail in a snow blizzard...

I mean if you are going to challenge Obama lawlessness, why not actually move to REMOVE him...rather than threaten him with a lawsuit he will ignore...

They aren’t powerless. They have impeachment (abuse of power qualifies, its the real reason Clinton was impeached), Congressional nullification of Federal Regulations, nullification of EO’s through constraining laws, withholding expenditures, and other measures too abstract to mention.

It’s beneath them to go to the courts. In the United States the Congress is first among equals, and who said they were equals anyway? The courts are constrained by Congress.

They need to start multi-pronged legislative initiatives on this guy and his co-conspirators and ramp it up until either he stops or they impeach him, and who cares about the ensuing riots. That will simply be the icing on the cake: don’t ever put an unqualified thug on the throne just because of his skin color.’

The proper remedy is to develop evidence via existing committees and then form a committee to impeach Mr. Obama. Irrespective of the nominal power of the Democrats, Mr. Obama has made a lot of Democrats very concerned, enough that a Republican majority in the House could get the ball rolling.
But the GOPe Mainstream Leadership in the House is corrupt and coerced and blackmailed into occasional Kabuki type rants with no action.
