People raised by violent abusive parents (who think they’re being funny or “just toughening you up”) have no idea how inappropriate or dangerous their behavior is.

I don’t understand the relatives in this idiot stunt, nor do I understand the sleaze behind suing the toilet manufacturers over idiot relatives. Everyone in the family is stupid, greedy, sleazy, or all of the above, and the manufacturer has to pay? Frivolous lawsuits disgust me.

“Adams and his wife sued the relatives along with the toilet manufacturer and installer, alleging the toilet was improperly installed on a slope.

I am not sure how the toilet manufacturer is at fault. The toilet functioned properly. I don’t think they can fault bad design or faulty components.

Under the two doctrines I mentioned, if none of the other miscreants involved have enough dough to pay off the judgment, than the toilet manufacturer will get stuck with the bill, as they will be judged to have the deepest pockets.

Also under strict liability the manufacturer is liable, no matter how idiots abuse, misuse, or improperly modify their products.

I suspect even he knows that it is frivolous. To take money from the manufacturer of a portable toilet just because your own cousins are morons who used their product to injure you is reprehensible. Had the seat fallen out from under him, paralyzing him, I would side with him, since that would likely be the manufacturer's fault. In this case, I fault the lawyers and their greedy client.

Strict liability is an excuse for frivolous lawsuits and needs to be eliminated. I understand the legal concept, but despite trying many times, I remain unable to understand those who would steal simply because the law permits that theft.

That is definitely insane.

Why not sue the manufacturer of the truck, the dealership they bought it from, the gas station where they bought their gas etc?

Why stop at the manufacturer of the outhouse?

Maybe - in a stretch - the company that set it up. But isn’t that like suing the contractor that built your house that was destroyed in an earthquake for shoddy workmanship?

Course I am probably giving the Ambulance Chasers some ideas here while trying to be completely facetious.

In the defense of the victim, he is paralyzed for life, and he will need expensive care for however long that is.

It’s not really his fault that the courts will eventually stick the manufacturer with the bill when his idiot relations are found not to have two nickles to rub together.

It’s been how these cases have been decided for a long, long time. At least in this state.

They get stuck or the taxpayer gets stuck. Life is unfair.

Considering that he filed a lawsuit against the manufacturer, I'm not sure I agree. His idiot relations are perfectly capable of providing the routine 24/7 care that he needs, and it's their moral obligation to do so personally if they can't pay for the consequences of their own actions. Making a blameless third party pay, simply because they can, makes no sense. Life is unfair, but government should not be complicit in exacerbating that unfairness.

I will never understand why the manufacturer was sued and not the idiot relatives. Though, I'm pretty sure their pockets just weren't deep enough. Nonetheless, it's an injustice.
