Treasury: Employers must “self-attest” that ObamaCare not behind staffing decisions

Full Title: Treasury: Employers must “self-attest” that ObamaCare not behind staffing decisions – under penalty of perjury

Old and busted: Businesses will love ObamaCare for its cost savings in health care! New hotness: Businesses had better not make staffing decisions based on cost savings from ObamaCare-fueled price spikes! After its latest delay in implementing the employer mandate, the Obama administration rebuffed criticisms that the law incentivizes employers to shift to part-time work by announcing the Treasury Inquisition — ahem, excuse me, the Treasury Attestation Department:

The latest announcement comes after the administration heard from businesses about their concerns with the looming ObamaCare rules. However, the change is sure to raise more questions about the health and implementation of the law. Fewer workers getting insurance through their employers could mean more individuals on the ObamaCare exchanges seeking subsidized coverage, increasing the cost to taxpayers.

Some lawmakers, though, have claimed that the mere threat of the employer mandate is causing companies to shed full-time workers in the hope of keeping their staff size below 50 and avoiding the requirement.

Administration officials dispute that this is happening on any large scale. Further, Treasury officials said Monday that businesses will be told to “certify” that they are not shedding full-time workers simply to avoid the mandate. Officials said employers will be told to sign a “self-attestation” on their tax forms affirming this, under penalty of perjury.

Officials stressed that the latest reprieve applies to a relatively small percentage of employers — albeit companies that employ millions of workers.

Er … exactly what gives Treasury the authority to demand that kind of pledge, anyway?

Are they also going to force businesses that are failing, because of Obamacare, to remain open?

Tax avoidance is legal. This is bs.

Not only legal but in the real world, it's mandatory, in business or your personal financial affairs.

But really, what liberal lives in "the real world"?

When you say that, it gives the impression that ignorance is behind these schemes. Don’t be fooled; they know exactly what they are doing.

I am reminded of the story, “Rumplestiltskin”, where a girl was told to spin straw into gold or be executed. Even the threat of death could not make her do the impossible.

If businesses cannot afford Obamacare mandates, no amount of bullying by the treasury can make them afford it.

It's called the " Floyd Ferris Rule"

“Did you really think we want those laws observed?" said Dr. Ferris. "We want them to be broken. You'd better get it straight that it's not a bunch of boy scouts you're up against... We're after power and we mean it... There's no way to rule innocent men. The only power any government has is the power to crack down on criminals. Well, when there aren't enough criminals one makes them. One declares so many things to be a crime that it becomes impossible for men to live without breaking laws. Who wants a nation of law-abiding citizens? What's there in that for anyone? But just pass the kind of laws that can neither be observed nor enforced or objectively interpreted – and you create a nation of law-breakers – and then you cash in on guilt. Now that's the system, Mr. Reardon, that's the game, and once you understand it, you'll be much easier to deal with.”

No. Im not going to lie. Labor costs have always been a factor in hiring/firing decisions. obamacare contributes to labor cost growth, and so it WILL impact these same decisions.

These fools are sounding more and more like old communist ministers every day. They cannot dictate simple math. Their lust for power and control cannot make 2+2=5.

Actually, one would think that's what a devious-yet-protocol-inclined administration would do. Maneuver the opponents into a factual situation they can then decry.

However, Obama and his ilk don't even need to do that any more. They just lie on the face of it. The media backs him up and he does what he wants to do. So, they'd just lie about firings anyway.

What they are really trying to do is intimidate employers to keep them from laying off people because, regardless of the lies about ObamaCare, there ARE people out there (a lot of them) seeing its deleterious effects and it doesn't escape them; it's OBAMAcare. THAT’s what he does not want.

I don’t think the idea is to keep business from laying off people. The idea is to silence anyone that does under threat of IRS audit and lying on the form. In today’s news 2.5 million were laid off from Obamacare and we can’t find anyone to admit that is why.

What part of the Constitution can check TOTALITARIANCARE?

Check$ and Balance$?

$ocialism Is Legal Plunder
Try to imagine a regulation of labor imposed by force that is not a violation of liberty; a transfer of wealth imposed by force that is not a violation of property
Since the law organizes justice, the socialists ask why the law should not also organize labor, education, and religion.
Why should not law be used for these purposes? Because it could not organize labor, education, and religion without destroying justice. We must remember that law is force, and that, consequently, the proper functions of the law cannot lawfully extend beyond the proper functions of force.

This is just plain tyranny.

As much as if a Democrat congress passed a 100% wealth tax, then Obama wavered all Democrats and those who swore a political oath of fealty to him, with penalties for disobedience.

It should be brought to the Supreme Court immediately, with an injunction against any wavers for anyone for any reason.

Importantly, since Marbury v. Madison (1810), the president cannot be compelled to act with a writ of mandamus; but the Supreme Court can most certainly forbid him from acting, if not him personally, then an injunction against anyone in his administration who acts.

Only once in the history of the Supreme Court has it acted as a criminal trial court. United States v. Shipp (1906).

http://en.wikipedia.org/wiki/United_States_v._Shipp

But the Obama administration’s tyrannical acts are such that the Supreme Court may be forced to act. Since Obama disregards the law, congress, and the federal judiciary, the Supreme Court can order the arrest of Obama’s subordinates who carry out his tyrannies, and try them for contempt of the Supreme Court.

Personally I would love to see such people dragged before the court in irons.

Treasury: Employers must “self-attest” that ObamaCare not behind staffing decisions

The truthful employers’ responses will be something like this:

“We have let go three of our least productive employees in order to reduce our payroll under fifty persons, to counter the crushing burden that the ACA will soon place upon our business if we keep more than fifty employees.”

Conservatives are having a hard time arguing against the delay when they originally wanted to delay it.

But remember the administration passed this by arguing that it would cut costs, reduce deficits, improve healthcare and save thousands of lives and be extremely popular.

Now they are delaying it because ostensibly it allows time for business to adjust, but really because they know they’ll get hammered in the election because it will hurt individuals and businesses.

This proves not only did they push this through based on lies, but they realize it was all lies.

It also raises the question as to what their original motivation was for ramming this law through.

This is how this needs to be argued.

ObamaCare IS exactly behind staffing decisions and the lying scum in DC are well aware of it.
Obongo, "Eric the Red" Holder, Hildy Canckles, and all the rest, should not be allowed to speak without being under oath, and they should be prosecuted to the full extent of the law the moment they are caught lying to the nation.
The double standard that the political elites employ must be terminated with extreme predjudice.
