Virginia Same-Sex Marriage Ruling Confuses Declaration Of Independence with Constitution

A federal judge struck down Virginia's ban on same-sex marriage today, an historic ruling with especial resonance on Valentine's Day. Except the history of the historic ruling isn't exactly up to par: Judge Arenda Wright Allen claimed the Constitution declares that "all men are created equal," which is, instead, the first line of the Declaration of Independence.

"Our Constitution declares that 'all men' are created equal. Surely this means all of us," Judge Allen wrote on the first page of her opinion. That line opens the second paragraph of the Declaration of Independence and appears nowhere in the Constitution. The line, in which Thomas Jefferson, with signature flourish, borrowed the words of theorist John Locke: "We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness."

Another ignorant affirmative action judge heard from....and this dummy is a judge who can throw out the laws of the citizens of VA. We have to clean house from top to bottom in our judiciary the next time we build a country.

Wright Allen joined the Federal Public Defender’s Office for the Eastern District of Virginia in 2005, where she had served as a Supervisory Assistant Federal Public Defender until becoming a federal judge in 2011.[4]

In this case, but among all the cases you find judges appointed by Obama, Clinton, and Bush.

The reality is that the judges are ruling in accordance with the precedence of Windsor vs US.

Ultimately, SCOTUS will take on one of these cases, and we can probably narrow that down.

The lawyers that will argue the case before SCOTUS are Ted Olson and David Boies, and since those two have been involved in California and Virginia, either the California case or the Virginia case will be heard by SCOTUS.

So, if you want to blame a particular judge, blame Scalia. He predicted that the state bans on homo marriage would fall after Windsor vs US. It was Scalia's statement that set off the multitude of lawsuits against the states.

But, who knows. Maybe Kennedy will vote differently this time around?

Political Correctness requires we all pretend that every black, like this dumbbell Affirmative Action appointee, are just as smart and accomplished as people like Walter Wiilliams, Benjamin Carson, Thomas Sowell and many others.

After all, she did point out that the Constitution declares that “all men are created equal”, didn’t she?

Only an unfeeling racist would point out that this so-called judge is so incompetent and uninformed that she couldn’t find her own derriere with both hands and a carbon arc searchlight.

People in VA are so tolerant that a liberal judge can confuse the Constitution with the Declaration, and the people will cheer because they too no longer know the difference.

I read the line about being created equal to mean that God created us to come in this world from Him as being born equal in God’s eye. I do not think it means that our outcomes are supposed to be made equal by man....or, er, woman.

I read the suggestion that since all federal courts are subordinate to the Supreme Court, that the Supreme Court direct that all federal judges are required to take a test as to their knowledge of the US Constitution, on an annual basis.

They can even study for it. But importantly, it is *not* an open-book test. They actually *have* to know the material.

And, apparently unlike their law school, they do *not* get grade adjustments because of their minority status.
