Minnesota man claims win over National Security Agency

AUK RAPIDS, Minn.—Federal authorities have dropped an attempt to stop a Minnesota man from marketing merchandise poking fun at the National Security Agency for its surveillance of citizens, including T-shirts bearing the NSA's official seal and the slogan, "The only part of the government that actually listens."

"It's a victory for First Amendment rights," said Dan McCall, of Sauk Rapids, who operates LibertyManiacs.com. He sued the NSA and Department of Homeland Security last fall after they issued cease-and-desist orders.

If the government lawyers had a decent legal education they would know parody is perfectly legal and I believe protected by the First Amendment when the government is the target.

The law the NSA cited in its cease-and-desist letter reads:
50 USC §3613
No person may, except with the written permission of the Director of the National Security Agency, knowingly use the words “National Security Agency”, the initials “NSA”, the seal of the National Security Agency, or any colorable imitation of such words, initials, or seal in connection with any merchandise, impersonation, solicitation, or commercial activity in a manner reasonably calculated to convey the impression that such use is approved, endorsed, or authorized by the National Security Agency.

Their lawyers couldn't figure out the problem with this??
