UAW Asks NLRB to Void Union Loss at Tennessee Volkswagen Plant

The United Auto Workers (UAW) filed a legal challenge late Friday with the National Labor Relations Board (NLRB) to the certification of the organizing vote it lost last Friday at Volkswagen's auto plant in Chattanooga, Tennessee. The challenge was submitted just hours before the seven day post-election filing deadline expired.

On Tuesday, attorney Joseph Farelli, a nationally recognized labor law expert, told Breitbart News the UAW would have little chance of success if it filed a challenge to NLRB certification of the election. "I don't think the NLRB is willing to break new ground and state the conduct of a third party is sufficient to void the outcome of the election."

As Farelli explained, labor law on the grounds for filing a challenge to an NLRB certification of an organizing election is very clear.

How uncommon in the age of Obama. When a vote doesn’t go your way run to the feds. When the feds don’t go your way, run to the courts. When the courts don’t go your way, burn the building to the ground. When burning the building to the ground doesn’t work go judge shopping until you find one that votes in your favor.

If I remember correctly did not Volkswagen allow the UAW into the plant and talk to the workers? Seems to me the UAW were the ones doing the coersion/thuggery.

they’d have to state some irregularity to revote i imagine. Of course the govt can make any claim they wish so its possible.

They either keep recounting, voting or litigating until they ‘win’. It’s the MarxoFascist/Democrat/Socialist/Union way.

They’re going to force their way whether the people want it or not, whether the people vote against it or not.

Truly the ONLY thing such people understand is brute force and the threat of force. The law and the will of the people mean nothing to them.

The NRLB, a communists arm of the King Obama empire, will win for the Union. We are a communists controlled Nation and see no opposition to the takeover.

Gee, they complain about a senator’s comments yet the union had the President speaking on their behalf. Seems to me Obama’s comments were far more damaging and the results should stand. I’ve already sworn off GM products despite my love for Corvettes and will add VW to the list (drove a VW for over 30 years and was considering a return to them) if they go union. This government interference in forcing a progressive agenda must be stopped, both in business and individual matters.

Yes, it’s exactly how they’ve overturned referundums that didn’t go their way. They’re all about the “will of the people” until it opposes their will.

No, Obama’s illegally appointed NLRB WILL overturn the results.

Will simply accuse the “no votes” of having been unduly influenced by politicians, and since VW doesn’t mind, they’ll be declared a union shop.

Are you an attorney? I do understand the NLRB can order another vote but you seem to be saying they can actually hand the victory to the union without even a new vote. Is that so and if it is can you tell me where you found that info because I cannot.

Are you really asking whether Obama and the NLRB would dare to act outside the law?

This would only be about the 177th time they’ve acted by fiat, outside the law.
