(Mark) Steyn countersues Mann for 10 millon dollars

Mark Steyn has decided to countersue Michael Mann for $10 million.

The legal document reads like a drama. See below.

FIRST COUNTERCLAIM

130. Plaintiff [Mann] has engaged in a pattern of abusive litigation designed to chill freedom of speech and to stifle legitimate criticism of Plaintiff’s work. He is currently suing Dr Tim Ball in British Columbia over a hoary bit of word play (“should be in the state pen, not Penn State”) applied to innumerable Pennsylvanians over the years. Having initiated the suit, Dr Mann then stalled the discovery process, so that the BC suit is now entering its third year – Mann’s object being to use the process as a punishment, rather than any eventual trial and conviction. See Mann vs Ball et al, British Columbia VLC-S-S-111913 (2011) (exhibit attached).

131.At the other end of the spectrum, Plaintiff and his Counsel have issued demands that have no basis in law, as they well know – including the preposterous assertion, in response to a parody video by “Minnesotans for Global Warming”, that “Professor Mann’s likeness” is protected from parody and satire…There is a smell to the hockey stick that, in Lady Macbeth’s words, “all the perfumes of Arabia will not sweeten” – nor all the investigations. And so Dr Mann has determined to sue it into respectability.

132. At the same time, Plaintiff continues to evade the one action that might definitively establish its respectability – by objecting, in the courts of Virginia, British Columbia and elsewhere, to the release of his research in this field. Perhaps he does, behind the scene. Now, I have no idea, of course. Just pure speculatin'...

Steyn is very quick on his feet. He will make mincemeat of Mann in court. He will not hold back the way a prissy white shoe lawyer will....who wants to maintain an image in the so called legal community of lawyers and black robes. Steyn does not have this problem.

Environazis like the Sierra Club an the EPA have been doing this for years. They seek to bleed your financial resources down to nothing using the courts which are all too willing to drag out the legal process for the benefit of their “brother lawyers.”
You know what you call a failed lawyer? Answer: Your Honor! Most judges were unable to make a decent living as lawyers.

any number of law firms across the land would take up Steyn’s cause
in a heartbeat and Mark knows that. He’s up to something pretty
big.

I'll tell you exactly what Mark is up to. He is very fast on his feet and has great stage presence if the job calls for it. You can see this when he is on TV or radio. Markie is going to tear Mann apart limb from limb when Mann gets up on the witness stand. Mark will eat him alive. Mann is  lo-IQ compared to Mark with awful stage presece

I trust Mark will have a lawyer with him in court to advise him. Outside court too
But Mark will be the lawyer the judge sees in court. Jury too if there is one

Kenyan thug style politics means take away your enemy’s livelihood and ability to make campaign donation to conservative causes. When Obama-EPA kill our coal industry (miners are already going bankrupt) this reduces their ability to fund pro-coal politicians who are the Republicans. Mark Steyn too might not get a donation from them

Kenyan thugs defund their enemies, tax them more, impose ObamaKare on them then transfer this money to liberal NGOs and Federal workers and the votes they buy via giving out ObamaFones, EBT cards, housing and other welfare programs that some are coordinated with the states. There are tons of lib NGOs feeding at the public trough (the Federal one) Just like in House of Cards where Frank Underwood’s wife heads up a do gooder NGO (operating where else but Africa!) which might well get private foundation money . But Federal taxpayer money too for sure given FU’s political power.

Exactly, great breakdown of the way the left has operated for ages. I don’t know why conservative politicians can’t seem to see this and support those who oppose their own enemies with more vehemence.

The problem is that AGW the researchers like Michael Mann at Penn State are not releasing their source code or raw data. So there is no way to verify their computer models independently.

Back in late 1980s when I was a CS undergrad at UMN and later a CS grad student at UIUC, I worked quite bit with researchers to fix up their Fortran simulations, doing code optimization for models run on Cray supercomputers and TMC Connection Machines at the MN Supercomputer Center and at NCSA.

In those days all the big federal granting agencies (National Science Foundation, National Institutes of Health, etc) required that any computer source code created or funded using federal research money must be made available to any US citizen on request. I spent plenty of time at the copy machine killing trees and spinning tapes for these requests. I tracked my time for billing purposes.

Some time after I left (not sure when) the federal research agencies quietly changed the rules. The requirement for public disclosure was dropped.

That is the whole problem. Bring back the requirement that, to get federal funding, you must make available your raw data and computer source code to anyone on request (and if they pay reasonable expenses for providing it).

That was the old rule in the 1980s.

It would fix the whole problem.

Thanks. In the Obama era just follow the Federal money. Who gets funded and who gets defunded. Who gets taxed more and who is paying zero Federal taxes and even illegally claiming low income credits on Fed taxes to get thousands in rebates like the illegal aliens love to do

As in defund Catholic social services with the excuse they do not provide abortion and birth control in their workers health plans. Then take this money to fund an Acorn type outfit to provide services the Catholic church once did. It migt be some black churches or leftist Lutheran churches. Thus providing jobs for Obama voters and supporters. No straight male or conservative can get these jobs

The fund and defund dichotomy. Keep your eyes on it

He doesn't have an attorney. After Steyn lost on the first go round in court, he wrote a column saying bad things about the judge, which prompted his lawyers to drop him as a client.

I read that Steyn fired his lawyers and that makes more sense than having a low life, scum bag, money grubbing lawyer dropping a paying client because he "said bad things about a judge".

Ummmm....He’s the guy Graham Spanier (famous for the Sandusky case) called on the carpet and said “Did you fabricate this global warming nonsense?” Mann said “No sir.” Spanier said “ OK, don’t let it happen again. Keep those grants coming in.”

Cool! I did the same thing at the National Center for Atmospheric Research in Boulder in the late 1970’s as a Research Assistant farmed out to NCAR by the CU Computer Science Department when I was getting my MS in CS at CU.

Yeah, it was pretty typical RA grunt-work back then. We charged hundreds of dollars for the dead trees and tapes. Nowadays it would probably cost $12 for the 4GB USB stick.

In a perfect world, there should be a rule that researchers receiving federal tax money should make their raw input data and simulation source code available on their web site. Sort of like the GPL.
