Scalia Warns Government Will Violate Civil Rights in War

At some point when America is at war, terrible violations of basic constitutional freedoms will occur. So says Supreme Court Justice Antonin Scalia.

Speaking at the University of Hawaii’s law school on Feb. 3, Scalia talked about World War II, where American citizens who happened to be of Japanese descent were placed in internment camps in the 1940s. This government action was taken to court and ultimately was upheld by the U.S. Supreme Court in Korematsu v. U.S.

Korematsu is one of the most infamous cases in American history. It was an unmitigated betrayal of the Constitution’s guarantee that no one can be deprived of life, liberty, or property without due process of law. How could such a thing ever happen in America? The answer, according to Scalia, is found in an ancient Latin phrase, inter arma enim silent leges.

If Scalia thinks this will happen only during wartime, he is very naive.

Well, we know two things: Scalia is not naive and he was speaking to law school students who likely know little about our nation's "civil war" or WWII.

IMO, he was clearly referencing the next war wherein Americans are required to fire on Americans.

His statement about governmental violation of civil rights is not new information for anyone who has more than a passing knowledge of either war. The WWII internment of Japanese-Americans was as much for their safety as it was for security purposes; at the same time, it was occasioned by the government's desire to avoid the disruption to the war effort that would be caused by an internal "war" raging concurrent with the global conflict.

Look how many freedoms have been squashed in the name of the "War on Terror".

Look at the militarism of local police forces sporting decommissioned military surplussed armored vehicles, and jack boots for all.

And how about buying up all those bullets for every Department you can think of. I'll bet there is now an appropriation of bullets for the school lunch lady.

And this all in the name of the supposed "War on Terror".

Our "protectors" have become the Terror.

Most people do not realize that Fort Meade (which spies on us) started out as an internment camp for German-Americans.

This sort of got diverted to gun control. I suspect what Scalia was more concerned about is that “Koreamatsu” has never been overturned as a SCOTUS decision. Contrast; the Jehovah’s Witness case over pledging alligiance was overturned in less than 4 years. Koreamatsu was declared “Moot” and has never been revisited. Pardon me for suspecting “they” might want to use that power again.

Yes Congress agreed to give some monetary reparations to those affected and even the heirs of those passed away as to the Japanese internment, BUT! there is nothing to keep it from happening again. Public opinion perhaps, but that swings like a weather vane.

If the radical elements of the IRA pull off a couple of costly bombings, could I, a 7nth generation Irishman who opposes the IRA and has never visited the “Auld Sod” get hauled off to a camp? There is nothing in the “Korematsu” decision saying “NO”.

A sad part of our history.
