Does anyone really believe if Civil Rights laws were repealed we'd go back to black and white drinking fountains? Blacks riding in the back of the bus? Separate entrances areas for blacks?

He’s right and it has nothing to do with racism.
If a business doesn’t want to serve someone because of their race, another business will open that will serve exclusively that race. And likely a 3rd business will open that serves all who enter and put both racists out of business.

Unfortunately, this would raise claims that it would “encourage racial discrimination” ...
see for instance,
Reitman v. Mulkey 387 US 369 (1967) where the USSCt upheld the California state Supreme Court’s overturning of a voter referendum repealing the California legislature’s Rumford Fair Housing Law (Yes, another 5-4 vote but it is there).
Not saying it shouldn’t or can’t be done.
Only saying anyone trying this needs to be well prepared (legally) to deal with just how it may be done (and how it may best be defended against challenge).

The section ruling on private industry was flatly unconstitutional. The Act had these elements added by Emmanuel Celler (D - N.Y.) after hearings during the negotiation. Republicans, though they were widely in support of the Act should have demanded this be taken out. It was blatantly an expansion of government illegaly into the private sphere, and short-sighted people that they were, they never imagined how the libs would abuse it.

They were afraid of being labeled racist the way Goldwater was and he was probably the most non racist among them. The man was practicing affirmative action in his own offices before anyone ever suggested it.
