I still say all this Obamacare crap is a scam to bring communism in through the back door. This has absolutely nothing to do with healthcare and everything to do with redistribution. They purposely make the cost of Obamacare too high to afford so most of the taxpaying population end up having to pay the “fine”. Only they will raise that fine every year until people end up owing thousands if not tens of thousands in “fines”. Then the Marxists do away with “taking the fine just from your refund” and instead start coming after your estate and finances: Liens on bank accounts, possession of your house, auctions, all that lovely stuff the IRS does, and what happens? You got redistribution, communism 101. Everyone works for the state and the state doles out what it sees fit.

Tell me how a man who will be 44 in a few days who lost his full time job and health ins, now has to work PT no health ins with a Wife who has Stage 3 breast Cancer, under going Chemo, and a 12 year old, and is a Type 2 Diabetic supposed to find health ins or pay for it, when they can barely pay rent and utilities on what he makes. She can’t work for a year. She gets Breast & Cervical Medicaid from IND. The 12 year old Medicad, the adult male because he is a US Citizen gets ZIP! His scrit ran out in Dec 2013. No $800 for testing and the ENDO to get a new one? And if he gets another PT job she will lose the Chemo treatments.

As written in the ACA (or at least how I understand it and have read several articles that claim the same); the IRS cannot collect the penalty through any means of wage garnishment, nor can they apply interest to the amount owed for the penaly/tax WRT to obamacare. They can take it from a refund owed to a filer, but cannot take any other legal remedies to go after a filer for the penalty.

The simplest solution is to find a health care plan that fulfills the requirements of the ACA (if you must have insurance), or if you don’t want to pay for healthcare insurance, then owe taxes every year and only pay the amount you owe for actual taxes and not the penalty. Clearly put on the memo section of the check that the money is for taxes owed and not the shared responsibility payment/penalty.

Of course you have to deal with rule by fiat from this piece of garbage who calls himself president, so you might have legal fees for going this route.

The mandate/tax only applies to your 2014 and beyond tax returns and not your 2013 return. What the IRS may not tell you is that the only vehicle they have to collect the tax according to the law is to deduct it from your refund. If you set up yourr witholding allowances and/or extimated tax payments so that you get no refund, they have no means to collect. They cannot levy your wages or bank account. Getting a refund is a poor way to save money anyway as the Government is just holding onto your money and paying you nothing for it.

Sorry to hear your story. I suspect while being sold as a means to insure all have health care, esp. those who cannot afford it, then those like you will not be able to afford it, but be taxed for not doing so.

But i do not have the word in that, but look to Jesus and pray in faith for help and deliverance.

Still does not answer the question of how a man who will file short form, and will not be able to find ins because of preexisting conditions for both will ever dig themselves out of the hole they are in.

I tied what little savings I have into annuities, Marital Trust and then secondary trusts.

When I did that they panicked and thought there was actual money in a Trust that would get her Medicaid cut off. I left neither of them a dime. Goes to grandson for college/trade school, books and tuition only per semester, want more get a job! 1 ER grant of $500 if it meets the approval need to the trustees who are not his parents.

Don’t bank on that foolishness, they will not stick with that. If there is no refund they will simply credit your tax payments to the health care tax and then you will be owing on your regular tax. They WILL NOT simply write it off because you are not owed a tax refund.

Nobody is suggesting lying on your tax return or anywhere else. The number of exemptions you claim throughout the year determines whether you pay in April or merit a refund.

Sure, but some folks surely will lie, not realizing what that can get them from the IRS.

FWIW I don’t blame you for calling out my first post. My homepage makes the same point after all. Sooner or later everyone is going to have to deal with the fact that the rule of law is currently null and void and any talk about that will be dangerous or very limited in scope.

Are they in a state that expanded Medicaid?

If they are in a state that did expand it, he can apply through the Marketplace and get insurance at probably very little monthly cost (if his income is low with that part-time job). The deductibles may still be high, but depends on the plan he chooses.

If they are in a state that did not expand Medicaid, he won’t get the low monthly cost (no tax credits/subsidy).

I’m sorry for their situation...hope things improve for all of them.

Supposedly insurance companies cannot turn you down for preexisting conditions because of the ACA provisos, that has been in effect for a while now I believe. True, you have to apply during open enrollment and may have to pay more because of it, but one can find insurance (it’s the whether or not you can pay for it part that gets in the way). A person who has the right income base and preexisting conditions can get subsidized or free health insurance (medicare/medicaid). The choices may not be to your liking, but they are there.

I don’t understand your last sentence, would you please re-phrase?

It would appear so. Thanks for noticing, and thanks for the “ping.”

I have a two year old FairTax “Ping list” which, when the occasion warrants, I use in an attempt to keep the momentum for FairTax moving forward, one mind at a time. The FairTax “ping list” I use contains names of some people who are no longer FReeping. But hope springs eternal in the human breast, so I continue to “ping” away, whenever I see an article that has relevance to the FairTax.

I’ve been in the “replace the income tax with a National Retail Sales Tax (NRST) and abolish the IRS” movement since April 17, 1991 (courtesy of a Pat Buchanan op-ed piece of that date), and was an “Inside the Evil Beltway (ITEB)” lobbyist for the NRST FRom 1995 until 2004.

My advocating and lobbying activities ITEB were a labor of love for me. I HATE THE INCOME TAX AND THE IRS! I was mostly unpaid for my activities ITEB. A small trust fund and some part-time work kept me going until my mother got too old to live by herself and I had to leave WDC and move to Jacksonville, FL.

Since I can no longer advocate for the FairTax ITEB, I do so FRom my keyboard and in my daily interaction with my fellow Americans.

As the Ophonybama depredations on our American Way of Life continue apace, and particularly in respect of the IRS, I expect that it will become increasingly easier to sell the Fairtax concept to both politicians and the American public.

FairTax advocates, both inside and outside the Evil Beltway have made steady progress in their education campaign, but much, much more needs to be done.

I NEVER IMAGINED THAT FReedom WOULD BE SUCH A HARD SELL!

If you or anyone reading this post wishes to get added to my Fairtax “ping” list, please FReepmail me and I’ll be more than happy to add you to our roll of FairTax supporters here on FRee Republic. Likewise if you no longer wish to be “pinged,” Freepmail me.

FairTax is a single rate flat sales tax on ALL goods and services purchased in the United States at the retail level.

FairTax replaces the income tax with a National Retail Sales Tax and abolishes the IRS.

For more information and to find out how to help us, check out http://www.fairtax.org.

I don’t believe that the “Super Majority” vote you call for is a show stopper. With FairTax in place, EVERY attempt by Congress to raise the rate would be met with some strong opposition by the American public. The fact is that all of the tinkering with the income tax has been done stealthily in the dead of night. Congress rarely publicizes the changes they make in the Internal Revenue Code to avoid the unwelcome and hostility such changes incur amongst the public.

FairTax is a 23% sales tax, not 31%. ALL essential purchases are rendered tax FRee by the rebate mechanism, so the tax is progressive, depending on one’s personal consumption above the essentials. We should studiously avoid engaging in class warfare rhetoric in these discussions, because once we go there, the LIEberals win. You will recall that the 2nd plank of the Communist Manifesto called for a “steeply progressive income tax” as a way to destroy the middle class. FairTax by not taxing work, savings and investments, will help rebuild our shrinking middle class, a phenomenon caused, in part, by the current tax code.

FairTax now has more public and Congressional support than it ever has. Momentum is growing, albeit slowly. We do have our work cut out for us!

I do not care about IRS job loss. Many will retire, others will find other work in government, and many will go find honest jobs. How often is “job loss” mentioned when the military services have a “Reduction in Force?”

Government is our slave, not our Master!

We must get used to demanding that government do our bidding!

No question about it — there are a lot of hurdles to overcome. HST, if we don’t try, we’ll never get there!

Let’s not burn the IRS down — we don’t need to go to prison!

HST, we can certainly burn the IRS down metaphorically. We need all the help we can get to do that, and there is no fear of going to prison!

Check FairTax out at http://www.fairtax.org, and we thank you for your help and support!
