Darrell Issa to recall Lois Lerner: Will the code of Omerta hold?

House Oversight Chairman Darrell Issa is recalling former IRS official Lois Lerner to testify about IRS targeting of conservative groups.

When last we left our intrepid Tea Party targeter in May of 2013, she was taking the fifth before Iss'a committee - after declaring her absolute innocence in an opening statement. The Oversight Committee has ruled that because she made the statement, she waived any right she had to protection from self-incrimination.

The Hill:

n his letter to William Taylor, Lerner's attorney, Issa said that her testimony "remains critical to this committee's investigation."

"Because the committee explicitly rejected her Fifth Amendment privilege claim, I expect her to provide answers when the hearing reconvenes on March 5," Issa wrote.

Taylor told The Hill he would probably respond to Issa on Wednesday. 

Rep. Elijah Cummings (Md.), the top Democrat at House Oversight, said that "only one thing has changed in the nine months since Lois Lerner invoked her Fifth Amendment right in response to Republican accusations of criminal activity - it's an election year."

"Republicans are wrong on the law, and calling her back will serve no purpose other than causing a media spectacle and feeding a false political narrative."

Cummings and other House Democrats had asked to hold a hearing with constitutional scholars before voting on whether Lerner waived her rights. Democrats have cited experts who said she did not.

Lerner’s attorney has previously denied that she waived her Fifth Amendment rights, and House Democrats have suggested that Republicans rushed into the vote ruling that she had. 

At that vote, held last June, both Democrats and Republicans suggested potentially giving Lerner some form of immunity to answer questions.

Isn't Elijah Cummings the guy who thought an island would tip over if they put too many US troops and a base on it?

At some point a Congressman must mention the death penalty for Lois.There have been no greater crimes against the Republic

Issa, you damn dreamer. She will cream you. You have displayed no real power and why in the hell don't you just give up. When you declare her in contempt and jail time then you might have a chance.

The House hearing(s) without end. I think Issa and the rest of his party think they can talk this into oblivion. They seem to figure that we, the flyover people will grow so tired of these scandals and hearings, we will just forget about the misdeeds of the Federals.

As much as I detest this woman, I don’t support this.

She is retired. Where does CONgress get the right to put retired people on the stand to testify about their former job?

If they are allowed to do this, what else can’t they do?

BTW, as a resident of the People’s Republic of Maryland (what’s in your wallet?) I am embarrassed by Elijah Cummings. He is nothing more than a partisan hack water carrier for the ‘Rats and Obama.

Quite a number of pathological malcontents have shown up on FR to dump on Issa, Gowdy, and Chaifetz, alleging that they are doing nothing in their investigations.

Building a legal case takes time from cooperative witnesses never mind from uncooperative witnesses as we have here. Had Obama's lackeys been more cooperative early on the investigation could have proceeded outside of an election year.

Too bad for Dems, I say.

I think Issa's Congressional team is timing this and other investigations to coincide with maximum exposure and impact, just like there was for Dems doing in Nixon in the summer of 1974.

Let's see what happens next week.

Obama ordered the IRS to oppress conservatives. The IRS stopped at least 500 conservative groups from organizing and so rigged the election of 2012 for Obama and democrats in the Senate

This Obama socialist/democrat must be impeached and must resign now for this

where is the conservative media covering this IRS scandal or calling for Obama’s resignation.Rush,savage, Hannity, Levin etc. are nowhere but they have 3 hours a day to REPETEADLY talk about the IRS abuses against Americans. the conservative media just covers what the evil liberal news media sets as the headlines

Given that we're talking about (alleged) illegal behavior, I'd say that they were perfectly within bounds as long as a statute of limitations hasn't run out.

Otherwise, "retiring" becomes instant immunity from Congressional oversight. (Which is exactly what they're trying to do here, by the way.)

The same rules apply to Lerner that have applied to every criminal underling who has ever been threatened by the government: Are they more afraid of what the government can do to them than what the person or persons they are protecting can do to them? Of course, with Obama/Holder in charge of the whole kangaroo court of American jurisprudence, perhaps the issue is what they can do FOR her, like protect her from prosecution.
