Ex-IRS official Lerner's attorney says no Hill testimony without immunity or court order
FoxNews.com ^ | 2/26/26 | Fox News.

The attorney for Lois Lerner, a central figure in the IRS scandal, signaled Wednesday that his client will not comply with a request to testify on Capitol Hill next week.

Attorney William Taylor said Lerner, who resigned last year as the agency’s tax-exempt organizations chief, will return and testify only if compelled by a federal court or if given immunity for her testimony.

Taylor stated his position in a letter to Rep. Darrell Issa, R-Calif., chairman of the House Committee on Oversight and Government Reform. He was responding to a letter Tuesday from Issa saying, in part, that Lerner’s testimony remains “critical to the committee’s investigation.”

The committee continues to investigate the IRS' targeting of Tea Party groups and other conservative organizations trying to get tax-exempt status.

Despite Taylor's letter, staffers with the committee told Fox News they still expect Lerner to show up on March 5. Unclear is whether she would answer any questions.

Then hold her in contempt right now, throw her in the slammer, and quit being wimps. This affects every American, dammit, and she gave up her immunity. What is this, fear of “war on women”? We have hemorrhoids for leaders.

Last I heard, the congress has the constitutional power and duty of oversight. A congressional subpoena is good enough. If she’s a no show, compel her to appear or go to jail.

You're absolutely right Jim - I take back my comment. Congress doesn't need a court order - separation of powers. Subpoena her, and throw her in jail if she refuses to comply.

Issa and Boehner’s treachery makes a replay. She should have been compelled to testify the instant she waived her Fifth Amendment rights. Now it’s too late, and we’ll never get at the meat of that walnut.

It appears she is having her way with this hapless committee. I doubt they’ll ever extract anything useful from her.

Pubbies are missing yet another opportunity to crack down on the agency abuses and make an example of those who violate the rights of citizens. But that’s how the Pubbie roll. They always look away from the gift horse. Pathetic.

Issa and Boehner the backstabbers would never do that because they approve of what the IRS is doing. For Lerner this ends right here, and she gets to go on and collect her pension.

Sorry Jim, but until we shake the RINOs out of the tree we’re screwed.

You NEVER give immunity unless you know exactly what she is going to say and then you get it in writing what she promises to tell and that immunity hinges on her saying exactly that.

If Issa doesn't subpoena her with threat of imprisonment if she fails to appear, the GOP's last chance to redeem themselves is tragically missed.

Political targeting and harassment by the IRS is one of the most serious crimes ever committed by our government. They engaged in voter suppression during the 2012 election and on a large scale as SOP WITHIN THE AGENCY UNDER OBAMA. Nixon's Watergate PALES IN COMPARISON TO MANIPULATING THE OUTCOME OF THE 2012 ELECTION BY SUPPRESSING THE REPUBLICAN VOTE (TEA PARTY)!!!!

The fact that no one has gone to jail over this makes everyone involved complicit in these crimes.

You are correct. The GOP wholeheartedly backs the IRS's shut down of the Tea Party and their failing to approve their tax-exempt status requests, thereby lessening the Tea Parties ability to garner donations.

'GOP backs IRS's shut down of Tea Party' IS the dirty secret in DC.

The GOP is too spooked by “war on women” propaganda to compel Lois Lerner to testify. The time to force her testimony was when she was a Federal employee. This becomes more difficult now that she is retired

If they give her immunity, she will tell them nothing and the committee will be left with indignant outrage and there isn’t a damn thing they will be able to do about it.

There has been a precedence that already been set back in the Reagan years.

Remember?

Court order? They’ll be back to square one with the Fifth Amendment and still not get answers.

[It appears she is having her way with this hapless committee. I doubt they’ll ever extract anything useful from her.]

Extracting actionable testimony is not nearly as important as political theater—hours of exposure on C-SPAN, delivering bombastic mini-speeches to witnesses instead of questions, nightly news sound bites, and meat for fund-raising emails.

Ah, but under oath if she lies she may be prosecuted. So if she takes a 'deal' and then lies- she goes to jail.

If she is subpoenaed and lies- she goes to jail.
