SAFE Act charges dismissed against Lockport man

Police officers went too far when they counted the bullets in Paul A. Wojdan's gun, City Judge William J. Watson ruled Wednesday as he dismissed the charge against Wojdan for violating New York's SAFE Act. Watson threw out the misdemeanor charge against Wojdan, which was filed because the magazine of his Ruger 9 mm pistol contained 10 bullets. That exceeds the SAFE Act’s restriction of seven bullets in a magazine.

Now, Wojdan wants all six of his firearms back. . . . .

Wojdan was a passenger in a vehicle that was pulled over by Lockport Police for speeding on Oct. 12. He had a permit for the weapon, which was in a holster in the glove compartment of the vehicle. Driven by Wojdan's wife, the vehicle was clocked by radar doing 44 mph in a 30 mph zone on South Transit Street at about 2 a.m.

Not unless the gun has a magazine disconnect. Even so, I wouldn't bet my life on it.

Federal District Court Judge William M. Skretny has found that most provisions of NY’s SAFE Act–passed only one month after the Sandy Hook elementary school shooting–do not infringe the Second Amendment.

He did, however, find that the provision that limits magazine capacity to only seven rounds was unconstitutional under the Second Amendment.

1. I’m sure the meaning behind that statement was that the police had a legitimate interest in making sure that the citizen was thoroughly disarmed and dominated before they proceeded to oppress him but that inspecting the magazine to see how many rounds were in it was not a legitimate part of that action an therefore constituted an illegal search.

2. I hope that Cuomo’s thugs know that most guns will fire without a magazine present.

3. I think California and other police states have done the world a huge disservice in requiring magazine disconnects because their existence in some but not all guns gives credence to the misconception that guns won’t fire without a magazine.

They say there is no quotas at end of month! That is bull$hit.Yesterday I saw 4 troopers in 4 different cars that had pulled over 4 cars caught by a fifth with radar on PA 422 East. A few miles down the road were 4 MORE troopers waiting for victims on PA 476 S. All this when they have a guy in Philly who robbed 8 different women at knife-point and another perp who shot a woman to death in front her mother because she wouldn’t let go of her purse. BTW, BOTH perps were “Amish”-One of the Brown Clown’s wanna be sons.

Whenever I hear that restaurant name I can immediately hear the Mighty Taco jingle being played over the PA at Ralph Wilson Stadium...

Cops have an infinite number of laws you can’t possibly know about so they can pull over anyone and give them a hefty fine.

They’re just revenuers.

I was working in Malibu,CA, one summer and while driving back to O.C in the afternoon it was hard to see very far ahead because of the glare of the sun,but we started to see a large number of CHP motor officers writing tickets. When we came up over a rise there were still 9 or ten motorcycle officers waiting for victims.

And we can thank Arnold the Awful for the “present” of 350 hand-held laser radar guns he “gifted’ the CHP with just prior to leaving office. Arnold worked “for free” taking no salary which was the only good thing he did aside from procreating with his Mexican housekeeper.

Not at all.

In fact, without a confession or other lucky break, it’s impossible to discover who murdered the “gun” without counting the bullets in it and subjecting them to a variety of ballistics tests, then matching those results against ballistics tests of bullets found in other murdered “guns.”
