‘The Romeikes Can Stay!!!’: Shocking 180 in the Case of German Home-Schooling Family
The Blaze ^ | Mar. 4, 2014 | Erica Ritz

Posted on 03/04/2014 12:51:44 PM PST by Mrs. Don-o

On Tuesday, the Home School Legal Defense Association (HSLDA) announced a drastic turnaround on the part of the federal government: The German Romeike family, which sought asylum in the United States to home-school their children, will now be allowed to stay in America.

“The Romeikes can stay!!!” the HSLDA announced on its Facebook page.

Just one day ago, the Romeikes thought they would be forced to return to Germany, where the state could take custody of their children because of their decision to home-school. At a minimum, they would face increasingly harsh fines for violating Germany’s compulsory attendance law.

Uwe and Hannelore Romeike have been fighting to remain in the United States since 2008, when they fled to Tennessee, but the Supreme Court declined to hear their appeal for asylum on Monday.

A post on the HSLDA’s Facebook wall signed by the organization’s chairman explains the change:

"Today, a Supervisor with the Department of Homeland Security called a member of our legal team to inform us that the Romeike family has been granted “indefinite deferred status”. This means that the Romeikes can stay in the United States permanently (unless they are convicted of a crime, etc.)

"This is an incredible victory that can only be credited to our Almighty God.

"We also want to thank those of who spoke up on this issue–including that long ago White House petition. We believe that the public outcry made this possible while God delivered the victory.

"This is an amazing turnaround in 24 hours. Praise the Lord.

"Proverbs 21: 1 The king’s heart is like a stream of water directed by the Lord, He guides it wherever He pleases."

~~Michael Farris

The family has claimed Germany’s laws violate international human rights standards, but the U.S. Sixth Circuit Court of Appeals concluded last year that U.S. law does not grant asylum to “every victim of unfair treatment.”

When the Supreme Court declined to hear the case, the HSLDA said the “last judicial hope for the family” had been exhausted. The 24-hour turnaround by the U.S. legal system was highly unexpected.

Programming note: Family attorney Michael Farris will be on TheBlaze TV’s “The Glenn Beck Program” at 5 p.m. ET to discuss the breaking details of this case.

I’m happy for the family, but don’t freepers understand when they’re being played?

Wow! Thanks for that! No telling how many FReepers would have morphed into Obama supporters.

“indefinite deferred status”

I would be careful about getting my hopes up. Let’s see after a few months.

Exactly. Much is moving from the areas of law and justice into the area of Obama's caprice.

I would not be surprised if that vicious apparatchik Eric Holder decided to get this Supervisor canned, or frame the Romeike on some kind of false charges.

Given the level of publicity in this case, there is no way this family would have been granted "indefinite deferred status" without sign-off from very senior people in DHS, and probably DOJ too. The Feds won their case, and set their precedent--foreign prohibitions on homeschooling are not cause for asylum cases--so, now they don't need to go after this family anymore. Plus, the Feds don't have to deal with the ugly optics of a protest against the deportation.

Put simply, Holder won't be going after this unnamed Supervisor, because the Supervisor did exactly what Holder wanted him/her to do

That’s what I get for not refreshing before responding. You’re exactly right. The Govt got what they needed out of this case, and they don’t want to take the steps necessary to carry out the deportation.

Well, if Obama’s illegal immigrant uncle can stay, why not the family who are not even sucking on the government’s welfare teat?

http://www.bostonglobe.com/metro/2013/12/03/uncle-president-obama-faces-deportation-kenya-today/04hVnIqteh0BIfyMn22XzL/story.html

EXCERPT:

A federal immigration judge ruled Tuesday that President Obama’s uncle can remain in the United States, sparing him deportation to his native Kenya in a case that riveted attention on the elderly man who had lived under the radar in this country for 50 years. For most of that time, he was here illegally.

Boston immigration Judge Leonard I. Shapiro said Onyango “Omar” Obama can now get a green card, and in five years, apply for US citizenship, unless the Department of Homeland Security appeals the case within 30 days.

The Ombamunists are even stupider than I thought, if they think they will be seen as benevolent because of this deferred status.

I'm thinking this was some DHS Supervisor acting within his authority, but outside of Obamunist policy. I want to shake that man's hand.

“No telling how many FReepers would have morphed into Obama supporters.”

Frankly, it doesn’t really matter whether freepers become Obama supporters. When the administration goes out of its way to persecute people this way and then does a 180 after they’ve accomplished their short term goals in order to use the situation to support another one of their goals, people need to be aware that they’re being manipulated.

It would be nice to be able to help this family. Does anyone know of a group or a link to a group to help them? Thanks.

Obama may just have not wanted a fair SCOTUS decision here because it would have led to a flood of Christian white immigrants - the kind he hates most.

If ANYBODY is stupid enough to think the current SCOTUS is a CONSERVATIVE one, this should disabuse them. Aside from Alitto, Scalia and Thomas, the others are activist judges.

You might want to donate to the organization which has been handling all their legal expenses pro-bono for at least 3 frustrating, nerve-wracking years:

http://www.hslda.org/legal/cases/romeike.asp>

This is a fine organization. They represent home-schoolers all over the country.

Sounds to me like the red state rat sinators up for reelection convinced barqy and holder to cease and desist until after the election.

This is a valid reason to give them sanctuary. I am glad they have been given it.

Besides donations to the HSLDA, is there some way to donate to help the family settle into their new home?

HSLDA is there for me, too, if the Authorities turn up wondering why my 2-year-old thinks she’s a character in “Assassins’ Creed IV.”

“The Government got what it wanted: a legal precedent that homeschooling is not an automatic entry to the US.”

I think it goes deeper than that. This government did not want to set the precedent of establishing Christianity as a persecuted class entitled to asylum.

I am as shocked as anyone that the Romeike’s get to stay. I’m tempted to thank Dear Leader, but I’m sure he just learned of it in the papers today. I will save my thanks for the Good Lord.

This might have something to do with it as well...

http://www.foxnews.com/opinion/2014/03/04/christians-vow-civil-disobedience-if-home-school-family-is-deported/

EXCERPT:

Christians in an east Tennessee community are vowing to engage in civil disobedience if the Obama administration initiates deportation proceedings against a Southern Baptist family from Germany who sought asylum in the United States so that they could home school their children.

“It may require civil disobedience with this bunch,” said Rep. Phil Roe (R-Tenn.), who represents the congressional district where the Romeike family lives.
