A district court judge has struck down a rule Iowa’s Republican secretary of state had drafted in hopes of removing ineligible voters — non-citizens — from the state’s voter registration rolls.
Matt Schultz, as secretary of state, is also the state’s commissioner of elections. The judge ruled Schultz did not have the authority to do what he wanted to do. The judge cited Iowa law which lists six circumstances in which the secretary of state may remove names from the list of eligible Iowa voters and none of those six deal with citizenship.
The American Civil Liberties Union of Iowa and the League of United Latin American Citizens of Iowa filed the lawsuit. The judge ordered Schultz to pay their legal bills. Schultz plans to appeal.
Schultz tried before the 2012 election to cross-check a list of registered voters he suspected weren’t legal citizens with a federal database, but the lawsuit was filed and that plan was put on hold. The rules Schultz drafted were never put into effect either, because of the lawsuit.
Schultz was elected secretary of state in 2010 and has focused on the issue of voter fraud. He is now running for congress.

So...if the illegals make it on to the voter roles by some means, then the Secretary of State can’t remove them, because citizenship is not among the six specific reasons codified in State law?
OK, got it.
Stupid on a galactic scale. Common sense is, indeed, in short supply.
Perhaps the Secretary of state is restricted by state law from removing registrations of non-citizens, but any state resident should be authorized to challenge such registrations and the elections directors must investigate and respond to such challenges. This brings it full cycle to removing registrations of non-citizens. This is bizarre to say the least.
The state legislature should convene at once and amend the law allowing removal of non-citizens from voter rolls.
In Iowa, apparently, citizenship is not a requirement to vote. Who knew?
It’s my contention that Iowa has one of the most corrupt election systems in the country. How else could fly-over country become so liberal?
There once was a nation whose young students were taught that one of the blessings of American citizenship was the right to VOTE. To “vote”..to actually have a voice in the world you lived in, and planned for your own future. I remember the FIRST time I went to the polls and made those little marks that told MY government who I wanted to lead MY country, my state and the city I lived in.
I remember immigrant neighbors, having at long last achieved that longed for CITIZENSHIP in this country, walking proudly as well as humbly to the polls for the very first time.
I proudly remember the young Filipinos in my division aboard the U.S.S. Frontier, serving in the United States Navy and thus EARNING citizenship and the right to vote.
Now, in 2014, the American Criminal Liberties Union stands to argue that American citizenship, sought for, fought for, and in thousands of cases died for, is now worth absolutely nothing.
Another once great nation slides down the dumpster of history.
Maybe citizenship was never put on the list because only STUPID progressives forget that voting is a natural birthright taught in elementary school Civics class and did not need to be codified.
Ignore the judge and enforce the rules anyway.
Registration of illegals is the intended result of the Cloward/Piven/Clinton motor voter bill, which did not permit those registering voters to inquire about citizenship. Voter rolls in every state are polluted with illegal, duplicate, fraudulent and dead voters. Purposefully.
This sounds like a technicality. Iowa should immediately amend the law to have a 7th condition.
That’s how you can suddenly find those forgotten ballot boxes in church basements and in poll workers car trunks in close elections. The Republican is ahead by over 5000 votes but you keep recounting until the democrat wins by 259 votes. Then the Republican concedes because they want to respect the integrity of the electoral process. Think the Washington state governor and Minnesota senate race in the last few years. It also most happened in Florida in 2000 with the selective recount in only 3 cherry picked counties but the Supreme Court stopped that one.

All courts below the Supreme court are creations of Congress. If we had a Congress filled with people who cherished our beloved Constitution, they would dissolve ALL Courts below the Supreme Court.
Then they could re-create a strict Constitutional lower court system.

When you have lame-brained judges like this, you know the country is in bad shape. While he acknowledges that the Sec. has authority to remove people from the voter rolls, he can not figure out why the Sec. can remove the most obvious individuals - non-citizens - from the rolls. There logically is no reason to spell out this exclusion in the state law since it is a universal Constitutional based reason for exclusion. Does this obvious, fundamental reason really need to be set down in a state law? Is he claiming now that non-citizens can vote in Iowa because the state law does not say they can not vote? What the judge is doing is creating a strawman and then proclaiming ‘checkmate’ to the Sec. A truly disingenuous act of judicial adventurism.
I will go again, but I will be a watcher this time.
