FALL RIVER, MASS. (WPRI) – A Fall River man has been charged with violating the Massachusetts wiretapping statute for recording a police officer talking on his cell phone and cursing while working a street detail.

George Thompson, 51, of Fall River, faces one count each of unlawful wiretap and resisting arrest stemming from the Jan. 6 incident.

Thompson spent the night in jail after his arrest.

Now the video is gone. Who do you think erased it?

"An iPhone can be wiped out remotely in the event it gets lost or stolen, but Thompson denied that he did so, saying he gave his password to police so officers could retrieve the video to use in his case."

I am glad I don't live near the Peoples Republic of Boston. They would surely have me in jail too.

the iPhone was erased while it was in an evidence room at the police station.

This proves there is no clown shortage.

The wiretap charge is bogus and about as chicken as it gets. It's payback for the LEO getting his teet caught in the ringer...I'd hire and real good attorney and make an example of them and make some money.

This one has a picture of the man who was arrested. And a little more detail.

There is no expectation of privacy on a public street. Video recording someone on a public street is not wiretapping.

I agree, but it appears that is not what is written in the MA state statutes.

However a Federal Appeals court has ruled as you stated. That Police cannot use video recording law to shield their action while on duty.

I do not consider today’s police organizations of any kind to be of the same societal class as mine i.e. plain old USA citizen who thought he fought in WWII for equality and had an only brother killed on Okinawa and buried in a simple grave in Hawai. I don’t go with the idea that anytime a law enforcement person dies or gets killed in the line of duty that I and many like minded citizens have to pay for all the travel and use of vehicles whereas a dead soldier in most cases gets a bare level trip home or plain vet ceremony.

I had an offer to transfer to the Boston branch of my company. Good job, good move professionally. I politely declined, then literally laughed out loud after hanging up. Not a chance in hades. I'd go go back to pumping gas and stocking shelves, and live in a used mobile home by the interstate before I'd move to Boston. (or anywhere in CA for that matter) I think we all have our "no way in h**l" places, right? Places we would never consider living.

If the alleged incident was erased from the phone, what evidence do they have that any crime was committed, the truthful word of the arresting officer?

He did not go into the street. He was doing it from his front porch, facing the street.

The policeman was swearing loudly to someone on the telephone. An elderly woman walked by at the time this was happening.

The man who filmed this asked the policeman to tone down his language and the officer swore at him and told him to mind his own business.

If you read the article it is pretty clear.

I don't see how that is wiretapping

If he was the person talking to the officer on the phone and recorded it, that would be wiretapping. What he was doing was videotaping somebody in public who has no expectation of privacy.

If this is wiretapping than most investigstive surveillance would be wiretapping, as well. Now that the evidence was erased, where is the proof in this case?

OLD STORY
Woman gets pulled over for speeding, cop walks up and she is fidgety and nervous. He asks for license and registration and she hands to him and hears her mumble something about the trunk. He listens closely and hears her mumble about ‘the body in the trunk’. Cop goes ballistic, pulls her out of car and calls it in. Other cops arrive, open trunk and find no body, while cop is trying to explain himself another cop talks to the woman and when told what is going on she said

“Oh...I wonder what would possess him to do that.
I suppose that lying SOB said I was speeding to”....

Well,in regards to Gay State cops it would take a while to explain but,as a hint,it's very easy and very common for cops here,State and municipal,to make $100K/yr with overtime. Also,a huge percentage of cops in this state somehow manage to retire in their 40's and 50's with a *disability* pension. To call police unions in this state corrupt would be to insult them with faint praise.

This kind of crap happens everywhere.

That did not start with Obama. It's been a work in progress for a long time, under both Dems and Reps. Neither has clean hands.

I don’t discount that there are those in both parties that contribute to this problem.

But it is clear that the ComDems are 100% subversive now. They have exterminated any pretence of objectivity of their POLs.

It is also clear that total ComDem control exists in some states and in some cities. Example: CA, MA, NY, WA

And this subversion is almost totally supported by the MSM.

It is also clear that some states will continue to resist this subjection. Texas is one of many.

Open carry is technically legal here in MA, but try doing it, you’ll have 5-0 up your ass in nanoseconds.

And that will be used against you for disqualification when you have to renew your CCL license.
