NYC to pay $98 million to settle case alleging FDNY discriminated against minority applicants

New York City reached an historic settlement with the Vulcan Society of black firefighters, agreeing to pay $98 million in back pay and benefits to minority FDNY applicants without acknowledging intentional discrimination at the fire department.

Good. Now let's move onto hospital workers in NYC next, where you are only hired if you are black or Hispanic and their union only accepts you if you are black or Hispanic.

Or how about traffic cops in NYC where your chances of finding one who is white is about the same as winning the lottery? Yeah, no bias going on there.

I’ve seen a sample test before, it is not racist in the least. The problem is the NYC education system, it is so horrible that the men who have gone through it can barely read so they constantly fail and the only ones who pass are guys from the suburbs, so of course it’s the FDNY that is racist and not the teachers union. This is such a joke it really is. They want to talk about REAL racism they should take a look at the 1199 hospital workers union in NYC which is just about 100% black and Hispanic. In the 1980s I tried to join them as I was hired part-time as a porter during a strike by their lovely union and I was told to my face that I would never get in because I was white. And here we are almost 30 years later and it is STILL 100% black and Hispanic.

I've always been curious about that, too.

HOW can a written test be "biased"?

And in order to squeeze out 98 million from taxpayers, why aren't we "allowed" to see EXACTLY what questions were "proof" of discrimination?

A few years back the city of Baltimore MD graduated a class from the Fire Academy with NO minorities.
It was a class formed a few years earlier and when it was put together it had the ‘proper’ number of ‘others’ ready for the Academy. Due to finances etc it was tabled.
When it finally convened and graduated it was discovered ALL the graduates were White.
Not sure but think O’Malley was still Mayor and ‘they’ had a kitten getting an ‘emergency’ class together so they could enhance all their quotas.

I am not sure but it wouldn’t surprise me if there were NO Whites ‘invited’ to the ‘emergency’ class. WOULDN’T THAT BE RACIST?

They were interviewing some of the citizens and one ‘extremely overweight’ Black lady quipped (After being ask if she was ‘upset’ no Minorities had graduated)

‘HONEY! I really don’t care what color the person is that can haul my fat ass to safety’

The EEOC assumes disparate impact is equivalent to discrimination.

In other words, the EEOC assumes that every demographic has exactly the same rates of academic achievement, the same rates of any measurable ability or interest, and that tests that fail more Non-Asian-Minorities than whites or Asians must by default be racially biased.

This puts emergency services in a bit of a bind. Well, really any occupation that requires employees adhere to objective, measurable standards of ability in order to prevent loss of life.

Ambulance and fire services for years have tried to maintain both objective standards of testing that measure essential abilities necessary for the jobs in question, as well as hire sufficient Non-Asian-Minorities to keep the lawsuits at bay.

Emergency services across the country have tried to accomplish the goal of both demographic representation AND basic ability by canvassing Hispanic and African-American communities and actively encouraging huge numbers of these minorities to apply in the hopes that they’ll find enough individuals that can pass an objective and non-racially biased test of basic ability.

If 90%+ of your white and Non-Asian-Minorities candidates can pass the test, along with 75% of your Hispanic and 50% of your African-American candidates, and if your test is not really biased and does indeed measure the abilities applicants need to demonstrate daily in order to keep from killing people, then in order to avoid legal shakedowns from the race hustlers you have to make sure that you have twice as many candidates of one specific race in the hopes that their average pass rates will get you some minimally qualified applicants to hire in order to keep from getting your ass sued off for having the gall to administer a test that actually measured technical ability.

That way, you can administer a test that ensures your applicants understand how to use a radio to communicate with dispatch, can speak English, can do basic grade-school math, and can remember that running 3 liters of oxygen per minute through a non-rebreather mask can suffocate and kill a patient.

It’s not the job of the fire department or ambulance service to ensure that every non-Asian-Minority in the country graduates high school with sufficient understanding of basic life skills. It’s not the aforementioned agencies’ job to ensure that all races, ethnic groups, and other demographics in society have exactly the same average levels of academic achievement or ability. However it IS their job to ensure that their employees have the ability to do their jobs, do them as safely as possible under dangerous circumstances, and do so without negligently killing people.

Somehow a test of firefighting procedures was deemed irrelevant for selecting candidates who would perform well as firefighters.

How did the 5% black and 9% hispanic firefighters pass the test if it is "biased", that prevented any others from passing?

Was the failure rate higher for blacks and hispanics? How was the bias proven? A comparison to the minorities percentage in the NYPD? How does that compare? Are there fewer opens and/or applicants to the FD than the PD?

Ah, it's all about the money. Anyway, $98 million divided among 1500 plaintiffs equals a little more than $65000. I wonder how much of that they'll actually see, and will they actually get FD jobs?

In the city of Oakland, Calif having a long, documented history of gang affiliation is NOT grounds for being disqualified for an officer position with Oakland PD.

It’s so common that everyone clear would be white or Asian, and it’s said that it LOOKS BAD if all the frequent flyers are urban and all the cops are from families that had been in farming or shop-keeping.

This means that some of the cops in Oakland are people who were gang-bangers but were then given a badge and gun and sent on patrol.
