Feds raid gun parts stores despite court order

SAN DIEGO – With a search warrant in hand, federal agents from the Bureau of Alcohol, Tobacco, Firearms and Explosives confiscated computers, customer lists and the questionable polymer 80 percent lower receivers from four Ares Armor store locations throughout San Diego County over the weekend.

“There were women and children inside our retail establishment when the (ATF) agents came in with guns drawn,” said Ares Armor Executive Officer Dimitrios Karras. “They came into our firearms manufacturing facility saying, ‘Arms up!’  like they were invading Iraq.”

The raid happened three days after Ares owner was granted a temporary restraining by a judge to stop ATF agents from searching their stores.

The ATF confirmed they were investigating the stores for federal firearm violations stemming from the sale of a new plastic version of the 80 percent lowers, which gun enthusiast use to build their own AR-15 rifles.

Building a rifle with specific versions of the 80 percent receivers is legal.   The polymer lower receiver appears to be manufactured differently with two parts, making them a firearm and illegal sell, according to the ATF.

“We did ask the court to clarify if these things were firearms or not,” said Karras. “We did ask for protection as this gets resolved within the court system.”

Karras said they had their polymer lower receivers locked in a closet ready to turn over to the ATF since Wednesday.  He was more concerned about the federal agents taking lists of his customers’ information.

“If anybody is a criminal organization that should be investigated, I think they should look in the mirror. We gave them a black eye publicly,” Karras said. “They tried to do an underhanded deal with us. They said, ‘Hey hush, hush. Keep it secret and nobody’s going to know that we took the customer list from you. Nobody’s going to know we took this from you.’”

The investigation has some customers nervous about their right to bear arms.

Another example of Team Obama IGNORING the Constitution. We are in a dictatorship when the executive branch refuses to be accountable to the other two branches of government.

Anyone still wondering why DHS is buying tons of ammo?

Why do we have an ATF again? Is it allowed anywhere in the constitution. Seems to me that Alcohol, tobacco and firearms should be the name of a convenience store not a federal police force.

Question here. I understand that Ares got a restraining order prohibiting the ‘raid’ but that the ATF got it rescinded or got another court to allow the raid despite the order. Does anyone know whether another court intervened to allow the raid? If so, under what authority did they allow the raid? I read this on an FR thread a few days back but have not seen any more of this. Anyone?

Sounds unconstitutional to me. It first got on its feet as the enforcers of Prohibition (prelude to Sharia), which was equally unconstitutional AFAIAC.

If the shop owner strongly suspected the ATF would raid his shop...why would the he even keep the list of (plastic part) purchasers on the premises? Now the owner looks like the victim...and the ATF conveniently has the list.

Odd.

I would not get too tied up with the Team Obama unit, they are just the current face of the totalitarian arm of the Federal Government. Come 2017, there will be a new face, BUT the problem will not go away. They are way too entrenched now.

So, the agents violated a court order. If Ares sues the ATF, the taxpayers will furnish the money for paying any damages.

IMO, What needes to be done is to have charges of assault with deadly weapons (entered with guns drawn) against each ATF agent.

Lon was a sniper at both. Lon is en extremely evil human being -- an evil cold blooded murderer.

I am sure he has no remorse murdering Vicki Weaver as she held her baby. I cannot write what I believe is the proper justice for that POS.

This reminds of SWAT raid to snatch Elián González and send him back to Cuba. His relatives were on the phone negotiating with the Justice Department when they let their guard down the INS launched their pre-dawn sneak attack.

He is also a West Point Graduate and an attorney. The amount of money and education poured into this assassin is truly disgusting. Sort of like training a pedophile as a pediatrician before setting him on his ‘career’.
