Judge Rules States Can Demand Proof of Citizenship from Voters

Arizona and Kansas can require that those registering to vote must prove their citizenship, and the federal Election Assistance Commission cannot stop them, even on the commission’s own national voter registration forms, a judge ruled Wednesday.

The ruling is a significant victory for states that have pushed to tighten voting against potential fraud. It marks a setback, however, for President Obama and other advocates who have argued that stiffer voting checks tamp down on voter turnout.

Judge Eric F. Melgren ruled that the EAC, which Congress created in the wake of the 2000 Florida voting fiasco, cannot refuse to include Arizona’s or Kansas’s demands that voters prove their citizenship.

“The EAC’s nondiscretionary duty is to perform the ministerial function of updating the instructions to reflect each state’s laws,” Judge Melgren ruled in a decision out of Kansas. “The court orders the EAC to add the language requested by Arizona and Kansas to the state-specific instructions of the federal mail voter registration form immediately.”

A spokesman for the EAC said they were reviewing the decision and it wasn’t clear whether they would appeal.

I wish it were a once and final decision, but as we welll know there will be a higher court overturn the decision in a matter of days or a week from now.

When did Congress create this?

How and why?

2015 it needs to be eliminated.

Of course they'll appeal, just as soon as they line up a suitably responsive liberal judge who will strike down the previous ruling.

Still, how do libs who are against voter ID suggest we make sure that those who are ineligible to vote don't get to vote?

Voter fraud is dilution of YOUR vote!!

Isn't that also the function of the Obama administration, to minister (administer) the laws of the U.S. as written by the legislature.

I know! They'll appeal it and ignore it while waiting for the appeal to go to court.

But since this is a federal judge's order, if they ignore it, then the state election registrars can in turn ignore invalid voter registration forms which get submitted.

I’m surprised the EAC didn’t get this case shopped to a California bolshevik judge, thus ensuring that if it went up on appeal it would be to the uber leftist 9th Circus Court of Appeals.
