Does the United States Election Assistance Commission (“EAC”) have the statutory and constitutional authority to deny a state’s request to include its proof-of-citizenship requirement in the state-specific instructions on the federal mail voter registration form? The Plaintiffs— Arizona and Kansas and their secretaries of state—say it does not, and have asked this Court to order the EAC to add the requested language immediately.

This would have probably prevented his election the 2nd time around. If more states join in and push for it the cry for amnesty will fade into the ether...

Terrible time for libs in Kansas this past week. First the KS Supreme Court didn’t do as expected but actually failed to screw Brownback and now the Fed Court didn’t do as expected but actually failed to screw Kobach.

And if an appellate court rules against the states’ rights to set their own election rules, the next Republican administration can use that as precedent to require voter ID at the national level for all states. They can also require that all states purge their voter rolls of duplicates and dead people and ineligible felons. The leftists need to be careful about pushing too hard for federal control and oversight of the voting rules that have been, thus far, up to the states. But it’s possible that the Constitution may still prevail. We’ll see...
