‘Permanent’ custody of Justina Pelletier awarded to Mass.

A long-running child custody case took a dramatic turn Tuesday, when a Massachusetts juvenile court judge awarded “permanent” custody of teen-ager Justina Pelletier to the state Department of Children and Families.

The ruling by Judge Joseph Johnston leaves it up to the agency, not the court, to decide whether or when Pelletier should be returned to her West Hartford, Conn., home.

“It’s a huge ruling,” said a person who had been briefed on the decision. “It’s a setback for the parents.”

This person said the state, which has had temporary custody of Pelletier for more than a year, has no immediate plans to have the 15-year-old sent back home, or to a facility in her home state.

But a decision to award permanent custody can be revisited by the judge after six months, at the parents’ request. The judge made his order retroactive to late December, so a review could occur as soon as early summer.

Rev. Patrick Mahoney of the Washington D.C.-based Christian Defense Coalition, who has become the parents’ spokesman, said Tuesday that Lou and Linda Pelletier are “outraged” by the decision, though they have yet to get a written copy of it.

“There is no reason Justina should not be returned immediately back to the parents,” he said.

Mahoney said the parents continue to believe that their daughter is being “treated as a pawn and piece of property.”

Judge Johnston also denied a request by out-of-state lawyer Mathew Staver of Liberty Counsel in Florida to represent the girl’s parents.

Sorry, but if I were her father, I would hunt down this judge and give him the opinion of my model 700. Up close and in person. We have reached the point where a family cannot keep its children. That to me is too far, and extra-judicial means become justified. I will be damned if some judge will tell me I cannot keep my child in my family...Time to take action is now....

This is stunning and I think there is more to this story. We were in a four year battle to obtain custody of my then three yo niece. Her mother, not married but living with the father was killed in a car accident. The father had a criminal record of drugs, theft, weapons charges and assault with a deadly weapon. At the time of her death there was a warrant for his arrest. He was never employed, had a dishonorable discharge as well as a diagnosed mental illness. There was evidence of child sexual abuse of his other child by a previous marriage.

The county we lived in did everything they could to reunite him with this child. ( In the best interest of the child) Everything, including lying and falsifying evidence. We eventually gained permanent custody but it was a long climb up. Incidentally, twenty-five years later he is in prison for first degree murder, serving a life sentence........we were right.

This is unlike any child protective service I have ever heard of.

That judge needs to be disbarred and everyone involved in taking this child from her parents, should be brought up on kidnapping charges.

This is INSANE!!!!

Let me second that motion. These "civil" issues can no longer be resolved by "being civil." If the state insists on tyranny, let it reap its own reward.

Judge Rules Justina Pelletier to Remain in State’s Custody

In response to the Boston Globe’s report that the state will retain “permanent” custody, Staver said, “there’s no way they could have done that.”

The Pelletiers say their daughter’s health is deteriorating. Two weeks ago at the one in-person visit they’re allowed per week with her, they said they noticed marks on her stomach that were worrying enough that they called them to the attention of Justina’s caretakers, who took her to the emergency room the next day.

Jennifer Pelletier, Justina’s sister, said in the most recent visit, Justina’s legs were more swollen and she lost feeling in her feet.

On Monday, the Pelletiers and their lawyers filed a contempt of court motion against DCF.

“DCF has abused its authority. DCF had no right to come between Justina and medical care,” Staver continued, noting that DCF said it would not bring Justina to Tufts until after Tuesday’s decision.

So what’s really going on with this girl? I can’t help thinking there’s something fairly basic about this situation that isn’t making it into these stories. Is there an allegation that the parents are causing some or all of the problem?

And you would be wrong. He was appointed by Governor Swift, a Republican.

I’m less concerned by Putin and Karzai than what our own government is doing to us right here and now.

Being in an institution like that, she WILL become crazy..this is what happens when liberals run things, this is what they do..if Im a parent and I have a sick child I would be terrified to bring him/her to the hospital, this can happen to ANYONE
