Man's parents win fight to keep him on life support

GEORGETOWN, Texas -- The parents of a Killeen man on life support have won a battle to keep him alive. Attorneys representing 43-year-old Terry Mace and his parents came to an agreement Thursday outside of court. Terry Allen Mace and Carol Mace will have control over their son's financial matter, as well as the ability to keep him on life support for the next 60 days. Mace's estranged wife was not a part of Thursday's proceedings. Her attorney did not contest the order presented to her by Mace's Attorney Ad Litem. On March 6, former Army Staff Sergeant turned military contract worker, Terry Mace, collapsed in his Killeen home. "We were literally mid-conversation, and it appeared he either fell back, or it was like the lights turned off," said Mace's roommate Kevin Herrera. Herrera called their other roommate, former Army EMT Rodolfo Salinas, to help. "He wasn't breathing, no rise or fall of the chest, and his mouth was locked shut, so I figured he had a seizure when he hit the ground as well. So at that point I started doing BLS, which is new for CPR," said Salinas.

Parents battle for custody after wife moves to have husband taken off life support

ROUND ROCK, Texas (KXAN) — Terry Mace was placed on life support at Seton Medical Center Williamson after having a massive heart attack on March 6.

On March 22, his wife, Yvonne, flew in from Colorado and directed doctors to remove Mace, 43, from life support. The couple is also in the midst of a lengthy divorce.

Now, Mace’s parents have filed a lawsuit to gain guardianship of their son, and stop their daughter-in-law from making decisions on his behalf. Mace’s parents claim their son is not brain dead and deserves a chance to fight on his own to survive.

When the breathing ventilator was removed, Mace’s parents say their son immediately started to breathe on his own. They then filed a temporary restraining order against Yvonne to have the feeding tube reinserted. A judge agreed, and the tube was reinserted on Saturday.

Attorney Stephen Casey, who is representing Mace’s parents, says 18 days is not long enough to allow someone to fight for their life. He also says Mace is responding to people.

“There have been responses,” said Casey.” In fact, his cousin was on the telephone and the phone was put by his ear and immediately his eyes popped open and tracked to that ear where the phone was located.”

Mace’s wife currently has the potential to inherit money if he dies, Casey said.

“We found out that there is a will and Yvonne and her daughters stand to inherit a good bit of money,” Casey said. “That’s a huge conflict of interest in her making any decisions regarding his end-of-life care.”

The parents and wife of Terry Mace will face off in a courtroom on Thursday.

KXAN requested an interview with Yvonne Mace, but she has not responded to our request.

Forty three years old? May God have mercy on his soul and may he recover. Pretty awesome that the roommates kept him alive until the ambulance arrived.

This is interesting and hopeful:

Mace started breathing on his own and was slightly responsive. On Monday, his parents contacted the Texas Center for Defense of Life. They filed an emergency application for guardianship and temporary restraining order against Yvonne Mace. A judge granted it and ordered nurses to start feeding and hydration tubes.

I wonder what the soon to be ex wife's motivation for removing him from life support?

What happened to that teenage girl who had surgery and ended up brain dead and the parents fought and won to take her out of the hospital that had declared her dead in December-January?

I read that the diabolical judge just gave permanent custody to the state of Massachusetts.

Jahi McMath and her family are to be honored by the Terri Schiavo Network this week. The whereabouts of the teen are kept secret but her mother says that physically the girl is doing better.

there was another case...a young girl who underwent a tonsilectomy and had somekind of heart attack or stroke and was declared brain dead....the parents fought to have her transferred to another facility on the east coast, and won, and I haven't heard a word...I do not expect any kind of miraculous recovery....

I read that this man in the story has three dtrs with the estranged wife and have had little contact with him, and that the divorce proceedings have been ongoing for several years....

if the attorney states that the ex wife and dtrs have a finacial interest in Mace dying, won't his parents have the same interest?....they're seeking guardianship or custody over him....

anyway, 18 days may be pretty quick to pull the feeding tube but it really depends on how long he was without oxygen and his condition....

I've insisted to my husband that if anything like that would occur with me, to please let me go peacefully into that good night...personally I have no wish to be kept alive on a tube feeding, a foley, a vent, and oxygen or any variation of the above....

If you are in the process of a divorce there’s no way the one spouse should ever be able to pull the plug on the other. the fact they are divorcing is intent to not be family anymore and they shouldn’t be able to end the life of a person they desire to stay family with. there becomes financial conflicts of interst in death benefits and also revenge.

this is a little different because they are divorcing and your example you’re still happily married. i would doubt you want a divorcing spouse to have the power to get rid of you and profit from your death.

His will says that the estranged (not actually “ex”) wife and daughers are the beneficiaries of his estate. So, no.

Each person is different. Different outcomes, ages, physical conditions, health problems, and so on.

A very old and good friend was in a coma due to a terrible head-on collision with a truck (tires on his car blew out), and of course docs wanted to pull the plug. His estranged wife came 5000 miles to take care of him and advocate for him. She refused to sign the pull the plug papers. Instead sat by his bedside and prayed and read to him for weeks. They said “he’ll die anyway”, then “He’ll never wake up”, then when he woke up, “He’ll be a vegetable”.

He is now walking, talking, working around the property, thinking, taking care of family interests, etc. And, he and his wife are no longer estranged and he is changed for the better so much that he is actually thankful for the accident.

PS. Very sadly, the hospital gave him Hep C. But he was around 50 plus at the time, so hopefully it will not have time to manifest much if at all.

First of all, it didn’t sound as though he was not breathing for very long. Second, there is no justification whatsoever for pulling a feeding tube on any living human being, any more than it is justified to stop bringing human beings plates of food.

Good news update. Terry Mace Sr. was granted temporary guardianship, effective for 60 days. His lawyer plans to file for permanent guardianship, if necessary.

It’s a relief to see a judge who upholds justice. There is never a time when it is acceptable for a court to order the medical community to starve and dehydrate a patient to death. And I’m really sick of hearing the excuse that the patient’s brain injury justifies murder. Caring for a brain injured loved one is difficult enough without having to defend them against those who would torture them to death “for their own good.”

Exactly, because any living human-even someone in perfect health- WILL DIE without water (in about 3 days), and food.

Wonder what these people would say if a dog was locked up in a cage and dehydrated and starved to death? Yet they advocate for this being done to humans who are already suffering and in poor health. Sick.

Terry Mace is safe for the next 60 days. If he doesn't regain his independence in that time, his Dad will file for permanent custody.
