Posted on 03/30/2014 2:38:34 PM PDT by CedarDave
Boise, Idaho (CBS SEATTLE) An Idaho state trooper arrested and fully searched a 70-year-old Washington mans vehicle solely because he had a Colorado license plate a state where marijuana is legal a federal license plate profiling lawsuit alleges.
Darien Roseen was driving along I-84 between his second home in Colorado and Washington state on Jan. 25 when Idaho State Trooper Justin Klitch immediately pulled out from the Interstate median and began rapidly accelerating to catch up to Roseen, according to the complaint in a Courthouse News Service report. Exiting at a designated rest area, Roseen says he became uncomfortable that Klitch had followed him though he had not done anything wrong.
~~ snip ~~
At no point did Trooper Klitchs line of questioning relate to Mr. Roseens alleged improper driving pattern, the complaint states. Instead, Trooper Klitch immediately accused Mr. Roseen of transporting something illegal.
Roseens attorney, Mark Coonts, told Courthouse News that his clients constitutional rights were given no regard.
We believe that Americans should be able to travel interstate highways without being harassed and unlawfully detained because of license-plate profiling, said Coonts. Our client, Mr. Roseen, is a 70-year-old retiree who was returning from his daughters baby shower. He was stopped in Idaho and deprived of his constitutional rights because he was driving a car with a license plate from a state that ISP associated with marijuana.

At least they didn't give him an anal cavity search like at least two cases in southwestern NM following a traffic stop.
The Country is LOST!
Right, and also lucky for him he didn’t have say $500 or $1000 in cash on him, or they would have seized that in all likelihood.
This sh*t has got to stop, excuse my language.
When did the cop stop abusing minors?
We have a local cop that pulls this crap with everybody. Officer Swanson.
Read another article that more people are coming forward with similar treatment. This is really sad. We visited Idaho in 2010... would have been very disappointed to have been stopped based on our plates.
But, most importantly, the cop went home safe that night.
Am I right?
Gun owners should be watching this one carefully. From time to time, I’ve heard of drivers from ‘pro-gun ownership’ states being pulled over in places like NYC and DC due to the suspicion that the driver could have firearms in their vehicle.
Read the entire story from the Courthouse News link above. Very scary; his rights were violated from the start.
What County should I be avoiding?
All I have to say about this is, get over it. I mean, I was stopped so many times in my youth because I had long hair, searched, handcuffed while they did it, and even accused of planning a crime. Each time they let me go, no charges. It’s what they do. Fascists will always harasses us
UUHH...OOHH!! Here we go.
In a few months, the State Police will have the opportunity to stop vehicles from a second state with legal MJ - Washington.
I NEVER attempt to cross Ill. with Lib’ “contraband”.
Idaho what is wrong with you?
Well, that should provide many hours of entertainment given the numbers of Wash. plates attempting to traverse the I-da-Ho' land mass.
Bingham. Particularly Shelley. This one is total a hole.
I looked a bit and this Klutz trooper sounds like another typical jackboot.
Idaho is surrounded by states allowing medical, or just plain smoking, pot.
60’s hippies were actually Libertarians....
One of the consequences of a regime of vices.
Primus - My Name Is Mud (LYRICS)
I thought I-84 ran from I-90 Sturbridge MA to Dunsmore PA ending at I-81.
Krap, I go that way relatively frequently (for me anyway). MT has all sorts of Medical MJ joints now.
It usually is.
Maybe a (not unreasonable) mud pack on the plate is warranted.
There are repercussions for Colorado’s decisions.
I wuz always happy to be staying overnight in Idaho Falls.
I really want to know when was the last time that the cop beat his wife.
Yeah well, I was once stopped because I was driving without my shirt on. The CHP officer entered the freeway, saw a Nissan tailgating my Mustang, pulled up behind the Nissan and red-lighted him. When the Nissan pulled to the right the CHP didn’t want him but pulled ahead meaning the red lights were for me. The officer told me he stopped me because I had my shirt off and that given the time of day (4pm) I appeared to be a construction worker coming home and that in his experiences construction workers have a bad habit of drinking and driving. I asked him if he really stopped me because I didn’t have a shirt on and he said that had I been wearing a shirt “we wouldn’t be here now”. I asked him what about the tailgater and he said tailgaters aren’t as dangerous as drunk drivers.
There is a second I-84 that runs from Portland (OR) to Utah.
“Get over it”? Nope.
[ Right, and also lucky for him he didnt have say $500 or $1000 in cash on him, or they would have seized that in all likelihood.

HOW DARE A CITIZEN CARRY CURENCY ON THE KING’S GRUNDS!!!!
There’s much more to the story behind the link.
all honest lawmen should get out now.
when the reset occurs government at all levels is gonna be cleansed of this corruptness.
In the west I-84 runs east from Portland OR, southeast through southern ID and into northern UT where it joins N-S I-15. Most of the time it is a 75-mph interstate except in Oregon where they are anal about speed limits and require an attendant to pump your gas.
I F isn’t too bad.
Stay out of the bar over at the Shilo Inn unless you are Mexican or just looking for a fight.
It is not legally sold at this point in Washington State except for medical marijuana and those permits are not recognized in other states.
“When’s the last time you used marijuana?”
“Hmmm, now lemme think. Yeah, when was the last time you molested a choir boy?”
You can’t search nuttin without a proper warrant.
You lied under color of authority.
Abused the 4th, 5th and 10th amendments and might as well toss in the 1st. You sought to legally and lawfully deprive me of my rights and begin prosecution of me based soley on where I had been and your presumptuous and pompous accusation, which extant to your deceipt implies you know who or what group of people I associate with.
I think I’d even go so far as to say you violated my 6th amendment fir excessive bailment and attendent provisions.
I would have no problem shooting your dogs to make a point but , fir the fact, I love doggies and can’t stand destruction of an innocent life.
If your dog could talk I’m certain we’d learn what a real Class -A Richard Head you are.
Dogs are like that you know. Honest and kind to a fault, unlike despicable wretches such as yourself.
You poosy. If you were snail slime there would never be a trail, as snails would be too embarrased to leave any trace of your miserable existence.
You will get yours.
Karma is such a bitch and there are days I thank God she is content on the hunt to, as she says, “pay it backward”. Mercilessly and with extreme prejudice.
When at the age of 70 you find yourself in despair, think back through your life and let your pussilescent presence be a torture to your mind and conscience until you are worm food.
Don't keep it secret -- tell us about it.
An officer has to be promoted to detective before he can figure that out. /s
Paladin, you are so correct. Liberals of today would have been considered fascists of the 1970’s
Don’t ever answer a cop’s questions and don’t ever give a cop permission to search your vehicle even if you are doing nothing wrong.
The LEO was just following orders, what’s the big deal?
NOW can I be on the JBT ping list?
Just sounds like a continuation of an unwritten reality that has gone on for more than half a century. A car with a “New York” or “New Jersey” liscense plate is always going to be a hair more likely pulled over in “Louisiana” or “Arkansas,” and vice-versa. Especially when a raggedy car and a raggedy driver are added into the mix.
Now, with the state of “Colorado” being synonymous with dope and dopeheads, it opens up a new welcome target. Hello, reality.
Unless Idaho is pulling over every vehicle from CO this lawsuit is bogus
“Do you have a warrant?”
“Am I under arrest?”
“Am i free to go?”
The only three questions you should ever ask a cop who has pulled you over
I chose to take my $4k ski vacation with my son this year in Utah rather than Colorado in significant measure because of my opposition to the pot laws.
Well with a little bit of searching it turns out that there are a few more details.
And every one of them make officer donut here look more out of control.
Familop meant that there was more crap done by the dipshit with the badge, right?
