SWAT Targets Family for Drinking Tea

In 21st-century America, the most innocent of activities could have a SWAT team busting down your door. Reason profiles the Harte family, who were the victims of a SWAT home invasion after police raided their garbage cans (h/t Ben Domench). An unreliable field test falsely identified Addie Harte’s trashed teabags as marijuana, and SWAT leapt into action. The Hartes didn’t just suffer the trauma of the raid—they had to spend $25,000 just to find out why they were targeted.

Since pretty much forever. The rationale seems to be that once you have put something in the trash, you have relinquished possession, and then anyone else is free to use it for any purpose.

Although I should add that if the trash is still on your property (within your curtilage), most jurisdictions will still require a warrant. If you have put it out on the street, probably not.

I buy Yerba Mate by the kilo for $6.99 at a New London, CT store the leans heavily Latin American everything. (Great store!) If they ever looked at my trash they wouldn’t even bother going to the judge to get the warrant. Other loose teas also in use, approach with caution. Irish Breakfast is my favorite.

In trashcans that I own and on my property (that I also own)? Wow. Sounds like an illegal search to me. Even if I put my trash on a curb, which I don't, I would expect the trash collector, which I contract to take it to the dump only.

What would have happened if the law-abiding residents were armed and ready to defend themselves?

I don't know, but I suspect when they do a gun grab, we will find out.
