Are we talking about filing for taxes? Or drawing blood due to implied consent laws? I can’t wait to click on the link! Maybe it’s searching because you’ve chosen to fly on an airline! Or, you’re within 100 miles of the border! Oh, the suspense is killing me!

There are a number of traditional exceptions to the requirement of a warrant to search. Usually, probable cause is required.

“The Obama administration has conducted warrantless searches of Americans’ communications as part of the National Security Agency’s surveillance operations that target foreigners located outside of the U.S., the administration’s top intelligence official confirmed in a letter to Congress disclosed Tuesday.

“These searches were authorized by a secret surveillance court in 2011, but it was unclear until Tuesday whether any such searches on Americans had been conducted.”

Your very existence is probable cause. That's why the Federal Register weighs 200 pounds. There are so many laws on the books that everybody commits a couple of federal felonies each day in the normal course of events.

Well, that may be true, but this part of settled criminal law is derived from the 4th, 5th and 6th amendments. Probable cause is generally required for a public search or seizure and traditionally requires evidence adding up to a totality of circumstances of a fair probability that the target person committed a crime or that the contraband is in the target location. With a couple of exceptions a warrant is required for search and seizure in a private home.

I know they're trying to chip away at this all the time, but this is basically how it stands now as far as I know.

We have a feral government that refuses to enforce federal immigration law. Obamacare transmogrifies on an hourly basis.

We no longer live under the rule of law. Stare decicis is dead.

You refuse to know no matter how much evidence is presented to the contrary.
