House Oversight and Government Reform Committee Chairman Darrell Issa, R-Calif., asked the panel's top Democrat to disclose communications between his office and the lawyer for former IRS official Lois Lerner, who faces contempt charges before the committee.
In a letter to ranking member Rep. Elijah Cummings, D-Md., Issa said it was vital for him to share what he learned from interviewing her attorney, William W. Taylor III.
The panel is investigating Lerner who headed the Exempt Organizations division of the agency when it controversially targeted conservative groups and will vote on contempt charges on the grounds that she has refused to cooperate with the probe.
"As you know, Mr. Taylor's position with regard to Ms. Lerner's willingness to cooperate with the committee has changed several times," Issa wrote. "So that all members of the committee can have a better understanding of Mr. Taylor's current position, please disclose any communications that you or your staff have had with Mr. Taylor."
Lerner has refused to answer questions about IRS targeting, using her Fifth Amendment right to remain silent. Reports have suggested that Lerner may seek immunity from the panel before agreeing to speak.
Republicans, though, say that Lerner waived her right to remain silent when she made a statement denying any wrongdoing, and charge that she is trying to delay the investigation.
Issa questioned if last-minute talks on immunity were more than just another stalling tactic and asked Cummings to share his discussions with Taylor.
"Your insistence on the prospect of immunity is surprising," Issa wrote. "In discussions with my staff, Mr. Taylor stated that his client does not fear prosecution and would not make any incriminating statements if she testified, with or without immunity.
"Ms. Lerner does not require immunity to testify truthfully about facts that would not incriminate her," he added.
Lerner served as the D.C.-based IRS official who some lawmakers believe played a key role in the practice of targeting certain conservative and Tea Party groups who were seeking tax-exempt status.
Issa and Cummings have had a strained relationship. At the conclusion of a committee hearing last month, the chairman turned off the Democrat's microphone after a testy exchange. Issa later apologized, which Cummings accepted.
That’ll just make him cry and make those unintelligible gurgling noises again, like he did when Issa turned off his mic. What a loser.
Is that woman to his right wearing a rubber mask,or is that really her face?I honestly can’t tell.
“Darrell Issa, R-Calif., asked the panel’s top Democrat to disclose communications between his office and the lawyer for former IRS official Lois Lerner, who faces contempt charges before the committee.”
That’s racist. I don’t know how or why, but it’s got to be racist.
The list, Ping
Let me know if you would like to be on or off the ping list
I’ve heard that Issa has sold the Trophy Room, as it is expected to remain empty for the next 3 years.
That’s really her face. Carolyn Maloney (D-NY)
Is that woman to his right wearing a rubber mask,or is that really her face?I honestly cant tell.
I believe both she and Cummings were in the process of “breaking wind”.
I despise that evil Cummings.
I marvel at the idiocy of Cummings.
The I remember Sheila Jackass-Lee is my Rep.
He won’t tell a thing that would help the committee or the American people. He is part and parcel of the stonewalling!
This may be a break, if it comes out that the dems
have been obstructing the investigation.(you know
they have...) Issa is playing a tough game, it doesn’t
seem likt he’s getting anyware but he may be building
something powerful. One can only hope.
That I believe, is what one would call, a 2 @ 10, and a 3.5 @ 2.
Here’s how Issa will unwittingly sabotage himself. He’s good on the front end but bad on the follow through. There’s no saliency to Issa wondering about this: It leads nowhere. He needs to stick to the center cut of the steak and not worry about the edges.
In addition to being very serious in terms of the implications, this is an issue that touches everyone provided Republicans can make the case. Because for example, while everyone wants to “help the poor”, nobody likes paying taxes and the very idea that the IRS is really the Internal Retribution Service can really get some legs in this era of relentlessly rising taxes.
Yeah, Benghazi is also a big deal but it’s only four people and half a world away. And there ain’t no evidence. With this IRS thing, there is massive evidence and I really hope Issa doesn’t foul it up.
Did I say “foul”?
Elijah Cummings is Miss Lois’s chauffeur.
Wow the smell coming from anyone associated with that lying lerner is becoming so bad that people in attendance will be required to wear gas masks.
Lying and corruption are the center pieces of the dumb-o-crat party, without those two ingredients they would have NOTHING it’s the bedrock of their existence.
Can I translate Issa’s comments:
Elijah, look, if you want to disclose this information, that would be great. If you don’t want to disclose it, well...there’s really nothing I can do about it.
Issa is a joke! We all know this will be going nowhere!
I cry fowl as in odorous. Too bad we can’t waterboard her.
She looks like she has the ‘should I spit or should I swallow’ look goin’ on.....
But the attorney does.
Conversations with the bald headed one are not priviledged
He will now have to tell what he told cummings or take the 5th
He divulged priviledged info to Cummings he is n troubbble.
Followed your Mahoney link. Is she related to DWS? I see a faint resemblance.
I have no idea, but I see what you mean!
yeah, Darrell, you can want all you like, but nothing Cummings would tell you could be trusted because he’s a lying scumbag democrip. The abortion of America is happening and the democrats are the aborticutionist of record. demonic bastards
Don’t ever allow those two to appear together in public.People will be turned to stone.
So Issa could bag both Cummings and the lawyer? Great!
I agree. Issa and several others on this Committee are good and anytime someone with top skills begins acting fumbly, someone trying to pull a fast one better be very careful.
What do they say? Dumb like a fox?
"Dead-End Darrell" strikes (out) again!
Carolyn Maloney, affectionately known as Carolyn Baloney.
Boy would I like to be a fly on he wall when / if those two ever meet privately!
Yes if only there were someone with even a vestigial spine that would hold such a person accountable. That is wishful thinking.
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation
This is a Congressional hearing, not a ‘criminal case’.
‘Person’, as stated by the amendment would seem to imply a private citizen living under its terms. NOT an officer of the government acting under color of law. The amendment even describes the routine of denying this privilege to the military. Ms. Lerner is merely an employee. Any actions taken in the course of her office do not have the privilege of the Fifth.
If Issa decides to grill Cummings he don’t get the fifth either.
Issa the toothless tiger roars again. Wake me when we take Washington.
That certainly makes sense. But Issa, Gowdy, and committee counsel are all focused on whether or not her statement before she exercised the 5th amounts to a waiver. They're saying if she hadn't made the statement beforehand that they'd have no grounds for contempt.
Does her retired status give her the ability to exercise the 5th Amendment privilege? Is that what's going on?
Cummins MADE the very first race card, bet your bippy he’ll pull it in a New York minute.
I still suspect Issa and Boys are laying a magnicicent trap and Cummins may have indeed trip the trigger with this lawyer. Now whether or not this lawyer will be willing to fall on his sword for the dem/libs is a different question, but I doubt it and once Cummins testifies something false per the lawyer discussion, he’s done.
Could be Issa has been waiting for just such a break and for a Senate change come November to begin nailing these perps to the wall. Show your hand too early, you get zip. Timing is everything!
The dems have put together such an elaborate house of cards, the whole thing might come undone in 15.
I knew I shouldn’t have clicked on that link
“Heres how Issa will unwittingly sabotage himself. Hes good on the front end but bad on the follow through.”
In hockey we say he is all Swedish and no Finnish.
I hope you’re right. Nailing Lerner, the IRS, and the dems all together will be sweet!
My bad, I should have stuck a warning label on it. B^)
Keep in mind that Cummings was personally appointed by Obama to co-head this committee.
This is a dog. This is a pony.
Those two remind me of a Twilight Zone episode.
Now how the Hell would Elijah Cummings know what he, or anybody else said?
I think its deeper than that. He's part of the crime. He participated in the intimidation of one of the patriot groups.
I think that's why he's barking so loud.
Summarized: The Fifth Amendment was never meant to protect the government from its citizens.
OMG!!! This pic is hysterical I need a new screen coffee all over it!!!
OBAMA HAS WEAPONIZED THE IRS AGAINST POLITICAL OPPONENTS ordering multiple covert campaigns of intimidation, threats, and persecution of tea party/conservative organizations, and those daring to criticize Obama's agenda.

DEMS STOOP TO CONQUEUR--order IRS to act to save their seats
by Alexander Bolton, The Hill, 2/13/14
Senate Democrats facing tough elections this year want the IRS to play a more aggressive role in regulating outside groups expected to spend millions of dollars on their races. In the wake of the IRS targeting scandal, the Democrats are publicly prodding the agency instead of lobbying them directly.
Dems are also careful to say the IRS should treat conservative and liberal groups equally, but theyre concerned about an impending tidal wave of attack ads funded by GOP-allied organizations. Much of the funding for those groups is secret, in contrast to the donations lawmakers collect, which must be reported publicly.
One of the most powerful groups is Americans for Prosperity, funded by the billionaire industrialists Charles and David Koch. It has already spent close to $30 million on ads attacking Democrats this election cycle.
If theyre claiming the tax relief, the tax benefit to be a nonprofit for social relief or social justice, then thats what they should be doing, said Sen. Mark Begich (D), who faces a competitive race in Alaska. If its to give them cover so they can do political activity, thats abusing the tax code. And either side."
Asked if the IRS should play a more active role policing political advocacy by groups that claim to be focused on social welfare, Sen. Jeanne Shaheen (D-N.H.) responded, Absolutely. Both on the left and the right, she said. As taxpayers, we should not be providing a write-off to groups to do political activity, and thats exactly what were doing.
Shaheen called the glut of political spending by self-described social welfare groups that qualify under section 501(c) (4) of the tax code outrageous. Shaheen is in a good position now but could find herself embroiled in a tight campaign if former Sen. Scott Brown (R-Mass) challenges her.
Sen. Mark Pryor (Ark.), the most vulnerable Democratic incumbent, said the IRS has jurisdiction over 501(c)(4) groups, as well as charities, which fall under section 5/01(c)(3) of the tax code and sometimes engage in quasi-political activity.
That whole 501(c)(3), 501(c)(4) [issue], those are IRS numbers. It is inherently an internal revenue matter, he said. There are two things you dont want in political money, in the fundraising world and expenditure world. You dont want secret money, and you dont want unlimited money, and thats what we have now. --SNIP--
