34 States Call for Constitutional Convention - and Possible Rewrite
Newsmax ^ | April 11, 2014 | Andrea Billups

Even with Michigan recently becoming the 34th state to call for a Constitutional Convention, it's not at all certain that a rewrite of the nation's founding document is close at hand...

Unless called to deal with a specific issue, some legal experts warn a "runaway" convention could create chaos.

"Let's assume that we get Congress to call for a convention, and we are deliberating about one item. Maybe that would stick. But how can you be confident that once you open the door to a constitutional convention, even if for one narrow amendment, that it won't just become a runaway convention?" said Steve Hayward, a visiting scholar in conservative thought and policy at the University of Colorado in Boulder.

"It seems to me that our Constitution may have problems these days, but I think most conservatives would be very nervous about opening it up to a new convention," Hayward told Newsmax...

These lies about a con-con are coming from the John Birth Society.

They cannot be engaged with logic, cannot be reasoned with, tout the same tired worn-out false arguments over and over... and over again. They are like a dog with a bone. Unfortunately, they are completely correct when it comes to Agenda21, CommonCore and other commie issues... thus getting some ears to listen that otherwise might not, but they have some ax to grind with COS, and won't budge no matter what reasoning is put to them.

F' em.

Because the States still have to ratify any amendments?

Not all of them.

How many went to Obama?

I am growing tired of this.
Many of those who are open-minded have already understood.
Many of the rest are becoming drones.
At this point, the only question that I ask is this:
Tomorrow, Congress can propose an Amendment to repeal the 2nd Amendment. Congress is empowered by Article V to do so.
How do you feel about this?
Their answer to this lets me know if further discussion would be productive.

It takes 2/3ds of all states to propose an amendment, and 3/4 to ratify it. The libs can't get rid of the 2nd with an Art. 5 Convention.

Yes, because 13 states are going to vote for that as well... Did you go to the link I provided?

The COS is talking about limiting CONGRESS as a whole... I don’t believe an amendment would make it out of an Article V Convention to repeal 22...

The Constitution doesn't have 'problems'. The politicians have problems. I'll be very interested as to which of them eventually try to get the results of a Constitutional convention declared unconstitutional.

Once they shut the doors and convene, they can do just about anything they want.

That is sort of how we got the current Constitution. Delegates met to reform the Articles of Confederation.

==

In the current political environment, the delegates could end up doing more damage than good.

State Legislatures control an Article V convention...

2/3 to propose and 3/4 to ratify...

This is why that LOCAL guy in your state is so important...

wny:" The Constitution as written is just fine.
We just need to use it again. "

Agreed !!
Those who have violated their oath of office need to be held accountable , .. and impeached ( at least ! )
Those who have knowingly violated their oath need to be "frogg-marched" and incarcerated , especailly if their activities have adversely affected the country.
There is no one, save 2-3 leaders in the country, that I trust to re-write the Constitution.

Congress and an Amendments Convention have the same rights of proposal, no more and no less. But there is one difference. Congress can propose any amendment it pleases at any time. But an Amendments Convention is required by the rules of contract law to stick to the language of its calling by Congress, and Congress extracts that language from the petitions from the states themselves.

In this case there may be enough valid petitions to force Congress to set the time and place for an Amendments Convention to address a balanced budget amendment, period. No other subject matter may be addressed, lest the Convention exceed its authority. Before anyone starts that canard about the original Constitutional Convention of 1787 exceeding its authority, I would suggest they read Madison's answer to that charge in Federalist #40.

They are correct about a Con-Con.

But somehow cannot read and comprehend the
Constitution particularly Article V

Another fallacy...

The delegates to the Article V convention (at least in GA) are BOUND BY STATE law with SEVERE penalties for proposing or discussing ANYTHING other than what we have charged them with...

Again, READ!

By narrowly defining the scope of authority to be placed with the delegates from each state, by each state?

This ain’t rocket science; just something promulgated by the founders that has never been tried before.

Executive orders / privileges of the President needs to be examined in detail to prevent what has happened the last 6 years so that it never happens again. Term limits for cronies, I uh mean Congress critters needs to be revised as well.

IOW, because Congress does not face the hurdle of Petition Aggregation, it would potentially easier for them to propose an Amendment for ratification that eliminated 2A.

Here’s the beauty... Kick out the feckless bunch we have now and NO president would be ALLOWED by an active Congress to let him get away with all the BS he does now...

HARD Term Limits for congress...
